My parents arrived in the USA in aug 2015 for what would be 6 months, they were here to help my wife and i with our second baby. During the stay i convinced my parents to move to the US. With 2 grandkids it didnt take much. In october they filed the paper work. They have already done the bio and we just got the travel paper worked approved.

They enter in aug with a B2 turist visa, and i filed i-130 that still pending.

Last week my fathers mom (88 years old) fell and broke her femur, and my dad wants to travel back.

My understanding is that with the travel documments he should be able to, but my question is will they say he over stayed his b2? Even though we applied for the change of status with in the 6 months.

When he returns to the US, he just shows his tavel document?

Will he need an interview for his i130 approval, or for parents there is no interview?

How long can he stay out of the country?

Needs AP to be able to get back in, assume he has that.

No time limit for being out on AP, but will need to be back for GC Processing, interviews are normal.

Well, depends what you mean by "travel paperwork". If you mean he applied for and has received his Advance Parole card, then like Boiler says, there's no problem.

If he doesn't have that, then he'll be abandoning the green card process if he leaves before it's been approved.
