Hello everyone,

I have not post anything since my AOS and now time for us to gain as much data as we can for my ROC. Got my GC on October 2nd 2013 so we want to fill around August this year. Here is our condition:

1. I have live in my native country since January 2nd and will back to US on June 7th (less than 6 months)

2. My husband earn less than $19.000 last year, but now he is in military so he definitely earn more than $19.000

3. Filling tax jointly for last 2 years

4. Husband declare bankruptcy last year but lawyer said that will be ok for my ROC

5. I am a student-University in US ( I do not know if this will help, but more information could help anybody to help me)

Do we eligible to fill ROC? Little bit concern because of my husband income and my visit to Indonesia.

Do you have a conditional green card? Then yes you MUST file for ROC before the card expires if you plan on continuing to live in the USA.

I interpret this post to mean your GC residency from date was October 2, 2013, meaning that you would need to have removed the conditions on it sometime within the 90 days prior to October 2, 2015

If that is the case, I am unsure how you would be coming back into the US in June with an expired GC.

I don't think there is an income threshold regarding ROC, so I think you are okay on that front. As for the time out of the country, you could always include in your evidence a written explanation of your visit along with emails, chat logs, etc. as proof of your regular communication with your husband while you were apart.

You have to show proof of a bonafide marriage, so they are going to question why u were apart.

This is true. Your USC spouse and/or joint sponsor has already filed the affidavit of support for you with the AOS so you do not need to re-submit income information, you DO however need to show proof that you have a bona fide marriage by providing documented evidence of your COHABITATION, commingling of finances, joint accounts, photographs, etc.

You need to talk to your attorney to explain why you were apart for so long. ALSO you should never be out of the country for more than 6 months at a time if you plan on applying for US Citizenship in the future within the 3 years of becoming a LPR.

So like everyone has said, i will sum it up, you don not need to provide proof of income or a certain required amount. You do however have to show commingling in finances..You WILL have to explain why as a marriage couple you have been apart for 5 months of your 1year 9 months marriage. IF you have all those things then u are fine to file.

Hello everyone,

Thank you to answer my questions. Somehow the answers isnt going to my email. Anyway, The reason why we are not together is because he is in training for military for 6 months. Me and my baby just feel lonely to stay in US without him so thats why we come to visit my mom. We will get prepare for our ROC. Thank you so much!
