Marrying a Chinese Police Officer

Hi all,

My fiance is a police officer. He is actually not a Party member, though, despite 7 years working in the PSB. I was wondering if anybody here has married a Chinese cop, and what kind of extra trouble his being a government employee might cause along the way. We got our NOA2 with no problems, but I'm nervous about whether it will become a problem at the interview stage. Is there anything I can do to preempt delays?

5/16/16- After a few days saying administrative processing, CEAC now says issued!

Additional snafu: my fiancé came over on his visa, but just a month later (and the day before we were going to get married) he had an emergency that necessitated him returning to China.  I contacted the Guangzhou consulate via their email system, provided the requested documents/proof, and he was granted a second interview for "reissuance."  He had to re-do the medical, redo the interview (bringing yet another copy of all of the things he had to bring the first time) and we were approved again!  He received what looked like a new visa in his passport, but the original 90 day countdown for marriage was still ticking.  He came back to the US and we got married right away!

As long as he is not an active CCP member I don't think you should run into any huge hurdles, but I cannot say for sure. I myself am marrying a Public school teacher, many of her co-workers are CCP members, but she herself is not. Schools in China are very government driven. I hope you find your answer.

I would agree with Chris, my wife's brother is a Peace Officer in China and he would make an excellent officer in the US. If you are not a active member of the CCP or have been recently, a terrorist, sex slaver, spousal abuser there should not me any issues. Many of my friends are married to Chinese people who have held jobs as teachers etc. with no issues. I would maybe expect some direct questions but noting out of the ordinary. Good Luck in getting to the end of the road. You CANNOT BEAT the system, it is what it is and be patient grasshopper.

《中国公民同外国人办理婚姻登记的几项规定》第4条规定:"下列中国公民不准同外国人结婚:(一)现役军人、外交人员、公安人员、机要人员和其他掌握重大机密的人员;(二)正在接受劳动教养和服刑的人."

Gonna run into this issue.

They may, they may not, since they are not getting married until he enters the US. They are not allowed to marry and obtain documents in China, but they are pursuing the K-1 route, so there would be no marriage in China, and I am pretty sure he would resign his position as well, seeing as he would be making arrangements to move to the US.

Thanks for the input guys! Yes, I'm aware that police can't marry foreigners by Chinese law; we have known since the beginning that he would have to give up his job. We're doing K1, and all of the official marriage stuff will be happening in the US on that visa, not in China. Good luck Chris and ZhiJia!

Hey, Megaflex, since you are skilled at looking up Chinese laws, can you let me know whether there is one that says that if police officers quit, they have to wait at least 2 years before they are allowed to leave the country? I'm finding mixed things about this on 百度. Mostly that it's not a problem, but now I'm nervous.

第一章

第一条 为规范公安机关人民警察因私出国(境)和同国(境)外人员结婚管理,依据有关法律和规定,制定本规定。

第二条 本规定适用于各级公安机关及其所属单位的在编在职的人民警察(以下简称公安民警)。

第三条 本规定所指因私出国(境),是指公安民警前往境外的国家(地区)或者香港、澳门、台湾地区从事非公务活动。

第四条 本规定所指同国(境)外人员结婚,是指公安民警同外国人、无国籍人员,香港、澳门、台湾地区居民结婚。

第二章 因私出国(境)管理

第五条 公安民警因私出国(境),应当符合法律和国家工作人员因私出国(境)有关管理规定,向所在单位提出申请,履行相关审批程序。

公安部机关处级以上人员、地方各级公安机关领导成员、任免前须征求上级公安机关意见的内设机构主要负责人,以及在涉密岗位工作人员因私出国(境)的,应当从严掌握。

第六条 公安民警申请因私出国(境),具有下列情形之一的,不予批准:

(一)涉嫌违法违纪,正在接受调查的;

(二)党纪政纪处分尚未解除的;

(三)出国(境)后可能对国家安全造成危害或者对国家利益造成重大损失的;

(四)出国(境)探亲、访友、奔丧、继承遗产等,其对象属于非法出国(境),出国(境)逾期不归,涉嫌犯罪或者在国(境)外从事危害国家安全和民族团结活动的;

(五)法律法规规定的其他情形。

第七条 公安民警在职期间不得出国(境)定居、赴国(境)外就业、自费留学。

公安民警以上述事由申请出国(境)的,应当按照有关规定办理辞去公职或者调离手续,进行公务交接,上交人民警察证、警服、警号、警衔标志、持枪证、公安数字证书、警用装备等,并执行脱密期管理。

公安机关政工部门应当将脱密起止时间通知公安机关出入境管理部门和申请人。

第八条 公安民警因私出国(境),在依据干部管理有关规定履行党政机关领导干部、国家机关工作人员审批程序之前,应当先履行下列审批程序:

(一)公安部机关及其所属单位局级以上人员,经公安部政治部审核后,由部长审批。处级人员,经公安部政治部审核后,由分管部领导审批。其他人员,由所在局级单位审批,报公安部政治部备案。

(二)地方各级公安机关领导成员,以及任免前须征求上级公安机关意见的内设机构主要负责人,经上一级公安机关政工部门审核后,由上一级公安机关审批;

(三)在涉密岗位工作人员,经本级公安机关审核后,由上一级公安机关政工部门审批;

(四)地方各级公安机关其他人员,经所在单位政工部门审核后,由本级公安机关审批。

各级公安机关政工部门审核审批时,应当视情征求本级公安机关纪检监察部门保密工作部门的意见。

第九条 各级公安机关政工部门负责公安民警因私出国(境)报告、登记和证件集中管理工作。

公安民警应当在申领因私出国(境)证件后的十日内向所在单位政工部门报告。政工部门应当及时登记持证人姓名、职务、发证机关、发证日期、有效期限、证件号码和证件的使用情况等。

公安民警应当在回国(境)后十日内,将所持因私出国(境)证件交由所在单位政工部门集中保管。

第十条 公安民警申请因私出国(境)或者出国(境)定居、就业、自费留学前,所在单位应当对其进行保密教育、保密检查、脱密期管理等,同时将教育、检查、脱密管理等情况呈报审批机关。

第十一条 公安民警不得在国(境)外向所在单位提出退休或辞职申请,不得私自办理外国永久居留权或者长期居留证许可、港澳居民来往内地通行证、香港或者澳门永久性居民身份证、台湾身份证及出入境证件。

第十二条 公安民警因私出国(境)后,不得以人民警察身份从事活动。

第十三条 公安民警中的中共党员因私出国(境)后,党员组织关系按照有关中共党员因私事出国(境)问题的规定执行。

第三章  同国(境)外人员结婚管理

第十四条 公安民警一律不准同外国人、无国籍人员结婚。

公安民警申请同外国人、无国籍人员结婚,或者其配偶加入外国国籍的,应当按照有关规定办理辞去公职或者调离手续,进行公务交接,上交人民警察证、警服、警号、警衔标志、持枪证、公安数字证书、警用装备等,并执行脱密期管理。

第十五条 公安民警原则上不得同台湾地区居民结婚,其配偶获得台湾身份证及出入境证件的,按照本规定第十四条办理。

第十六条 除涉密岗位工作人员外,公安民警可以与符合下列条件的香港、澳门特别行政区居民结婚:

(一)具有中华人民共和国国籍;

(二)拥护中华人民共和国宪法和特别行政区基本法;

(三)法律法规规定的其他条件。

涉密岗位工作人员申请与符合上述条件人员结婚的,应当事先调整工作岗位并执行脱密期管理。

第十七条 配偶获得国(境)外永久居留权或者长期居留证许可的公安民警,不得在涉密岗位工作。

第四章 附  则

第十八条 本规定所指公安机关领导成员,包括公安机关党委(党组)成员,行政正、副职领导成员。

第十九条 处于试用期的新录用公安民警或者退休不满两年的,按照本规定办理。

第二十条 铁路、交通、民航、森林公安机关和海关缉私部门按照本规定执行。

第二十一条 本规定由公安部负责解释。

第二十二条 本规定自印发之日起施行,公安部制定的其他有关规定与本规定不一致的,按照本规定执行。公安部198411月《关于公安干警因私出境和同外国人结婚问题管理的规定》和公安部政治部19925月《关于公安干警因私出国(境)和同外国人结婚等有关几个具体问题的通知》同时废止。

附:常德市公安机关公安民警因私出国(境)审批程序

1、公安系统市管干部因私出国(境),由本人填写《国家工作人员因私出国(境)审查表》,经市公安局主要领导审核后,报市委组织部审批备案。

2、市直公安机关公安民警因私出国(境),经所在单位政工部门审核盖章后,由市局政工部门审批;市局公安民警因私出国(境),经所在内设机构主要负责人审核盖章后,由政工部门审批。

3、县级公安机关公安民警因私出国(境),经所在单位政工部门审核后,严格按照干部管理权限履行审批手续。

Yeah, it seems like certain types of police might be required to stay inside the country for 2 years after they quit in case they know any secret information. In his job, he definitely doesn't have contact with anything secret, but we were worried how flexible or up for interpretation that law might be. It seems like we should be good!
