The Packet 3 Letter from Manila Embassy States this:

POLICE REPORT (NBI Clearance). Applicants aged 16 years and older must have a valid Record Clearance (for travel abroad purposes) from the National Bureau of Investigation (NBI), Clearances should be in the applicants current name, birth certificate name, maiden name and any aliases or nick names used, including different spellings you have used for those names. An official letter of explanation from NBI is required for any notation of “No Criminal Record” or “No pending case”. For immigration purposes an NBI clearance is valid for (1) year after its issuance date.

  1. My first question is my fiancée just got her NBI Clearance for “U.S. VISA” not as shown in the above highlighted statement (for travel abroad purposes). However her NBI Clearance is green, does she have the correct NBI clearance?
  2. My second question is what does this statement mean? An official letter of explanation from NBI is required for any notation of “No Criminal Record” or “No pending case”. I'm trying to figure out if my fiancee needs this letter from NBI?

1. Green and travel abroad presents no problems.

2. NO CRIMINAL RECORD and NO CASE PENDING means she is in the NBI's database for a possible past offense or for someone else who has a similar name.

If her NBI says either of those two phrases, she needs to return to the NBI and request a letter of explanation as to WHAT she is in the database for. If she can't get a letter then she needs an explanation (verbal will do) so she can make any corrective action prior to the interview. Sometimes some are in the database because someone has a similar name or has a name like hers and what they did, created the "hit" for her. Don't panic, but get to the bottom of the problem and resolve the issue(s) prior to the interview if possible. Be stern in your request as sometimes you will be sent away with nothing. Not resolving the problem will create a delay for the visa issuance.

If her form says something like NO RECORD ON FILE or NO DEROGATORY RECORD then she has nothing to worry about.

NBI CLEARANCE (USEM requires Green Form). Applicants aged 16 years and older must have a valid Record Clearance (purpose: for travel abroad) from the National Bureau of Investigation (NBI). Clearances should be in the applicant’s current name, birth certificate name, maiden name and any aliases or nicknames used, including different spellings you have used of those names. An official letter of explanation from the NBI is required for any notation of "No criminal record" or "No pending case". The NBI clearance is valid for one (1) year from the date it was issued but the USEM Consulate requires it to be no older than 6 months at the time of the interview. 1) As long as the form is green in color you are fine.

2) Does it have either of those notations on the NBI? If NO then relax... if you have either of those notations on the NBI nothing can be done until the interview and the EMBASSY issues a 221g letter (arrives by email) requesting the letter of explanation from NBI... THEN you take that to NBI. NBI will not give you a letter of explanation without a request from the embassy.

Thank you everyone for your answers. My fiancee's NBI Clearance say's "No Record on File", so looks like nothing to worry about and she won't be required to get letter from NBI. Yea!

The NBI Clearance she has is "Green" But states "Purpose for U.S. Visa" but does not say anywhere on it for Travel Abroad.
