Divorce before card Green card approval

Good day,

I will try to summarize my situation as best as I can....I need some advice on what to do.

I got married early 2011 and started my i-485 application about a year after marriage. Everything was going well and we went for the interview. The officer said everything was fine after the interview and we went home. We waited for months afterwards and didn't hear back from them.(No helpful reply till today)

I had some issues and things started going bad for me financially and in other areas.. Because of this I had to move in with my wife and her Mom. We started having problems a few months(4-5 months) in. I will spare the extra details but I got divorce papers to sign in December 2014. I tried to work things out and do everything possible but nothing worked and the divorce was finalized in 2015.

During all of this I still did not get any proper response from the USCIS. The last time I contacted them..I got an email saying there is a back log of files and they are waiting for the FBI to get back to them on my background check.
I was told by a friend that because I already got a divorce my case will be denied and there is nothing I can do...I need help or advice please I feel stuck and tired.

Wait was this a marriage based adjustment of status? If so why weren't you already living with your wife?

If your ex wife has pulled the affidavit of support then your adjustment of status is dead.

If you are adjusting from a fiancé visa then you cannot adjust your status through anyone else.

We were living together in MY house when we married but because of my financial situation we had to move out of my apartment after about 2years and move in with her mom.
I don't THINK she has pulled the affidavit of support

AOS being granted after divorce can be possible for K-1, but isn't possible for other situations. So I would agree with your friend.

If you submitted your application for AOS in 2012 you should have heard something by now. Something seems to be missing here. It does not take 3 years to get a green card.

That is what I said as well... but the story they give me when I call is that they are waiting on my background check.

request an info pass. I've seen a few cases like this and the only thing that got it moving was an infopass. I really do not mean to scare you but this is not regular.

To continue to chase a marriage based green card that has not been issued would be fraud if you are divorcing, you may stir up a hornets nest while chasing what you want.
