Hi,

My ex wife and I have been separated since May, 2014, she has an affair and left for her lover. Filed for divorce in July, 2015, then I took a vacation to Laos and met my fiancee. Divorce is going to finalized in March 1, 2016. How long should I wait after the divorce to filed the petition for my fiancee? I was thinking about filing in April, should this be okay?

Are you a US citizen? If so you can file anytime after your final divorce decree is in your hands.

I was separated 4 years from my ex but not divorced. My divorce was final on Nov. 5, 2015 but I didn't get the documents for a little while to prove it. I applied for my K-1 Fiance Visa in December. We are approved and awaiting NVC to contact us now. So if you are US citizen, I agree with Proudly Canadian. Divorce is Divorce. When it is final, it is final and you can move on to your new life. I only asked if you were a USC because LPR can apply for a spouse but not a fiancé(e). Don't take offense.
