A friend of mine asked me to help him with the following:

Spouse is the petitioner and sponsor ,but her income is less than the 125% poverty level which in their case should be approx $25000. He wants me to co sponsor him (im not sure im ready to do that ) so i suggested to submitt assets in which in their case would be their property in the USA which is free and clear , he has the tax valuation for the county( which is generally appraised at less than market value and indicates its $ 277.000) and the deed

Would this suffice to be approved? I would think this is a cut and dry case but i want opinions from the forum.

Another question ....when they submit the I130 + I485 how long does it take to have the petition approved?

When do you submit the I864? Toghther with the I130 ?

I will accompany him to see an immigration attorney this week and just would like some ammo with me for the discussion.

He wants me to be cosponsor even if he submits assets ,would my cosponsorship be waived or ignored when they see he has sufficient assets? Thanks in advance for clarification....

Where is the foreign spouse now? You've posted in the CR/IR-1 forum, which is for married people where the foreign spouse is abroad and wanting to immigrate to the US to join the US spouse. You don't use i-485 in this case.

If the foreign spouse is already in the US, then they're doing adjustment of status, in which case you've posted in the wrong forum and yes, they do need the i-485.

the steps and timeframe is different depending on if it's a CR/IR-1 visa or adjustment of status that your friend is doing.

Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning

What petition did they file I-129F or I-130? Are they married or no? What's the household size 3 (since you stated $25K). This will help answer the questions.

Also the country where interview will be (that's if the beneficiary is in their country). Or are they here?

What petition did they file I-129F or I-130? Are they married or no? What's the household size 3 (since you stated $25K). This will help answer the questions.
Also the country where interview will be (that's if the beneficiary is in their country). Or are they here?

They filed I130 ,they are both ibn the US , the sponsors income is 15000 /the required incme would be 25000 ( 3 person household including immigrant)
House free and clear in both of their names / no mortgage

What Visa did the immigrant come to US on?

The problem with using house as asset is they usually won;t allow it if its their primary home. They could try and that value is en0ugh (asset has to be 3 X what they need so that's $75000 they need in assets).

Sue they can sure try and they need appraisal of house also.

Since they are doing adjustment of status yes it will be the I-485 and the I-864 goes in with the whole petition package.

Worst case is they get a RFE (Request for Further Evidence) and they say they need a joint sponsor. Or they accept. It's taking 8 to 12 months to get approval and green card. No fast thing thing.

Real estate used for assets need to have a recent appraisal done by a licensed appraiser. The tax valuation will not be sufficient. (see the I-864FAQ link in my signature below)

If they accept the house/home as an asset then your joint sponsorship would not be needed. Your income needs to be enough to cover your household count plus the intending immigrant(s).
