I've already received my NOA-1 for I-129F via snailmail on 2/27/06 with receipt date 02/22/06 , so I'd like to get ready for NOA-2 and I understand that the consulate in Bogota , Colombia requires AOS 864. I have some questions that hopefully my dears VJ's friends might be able to answer them.

1)On this past year income tax I made a little over the minimum requirement for a household of 3 , but just to be on the safe side my best friend whom lives in a different State will co-sponsor my Stepdaughter. Can he sponsor her eventhough he does not lives in the same State as I live?(I will sponsor my wife)

2)Can I print out an 864 form from the internet fill it out and send to him so he can notarize it?

3)Does he need the last 3 years income taxes and original W-2's?

4)Can my wife use a notarize letter for future employment in the U.S. due to her skills as an extra way of income?

Congratulations on your NOA 1.

1. Your friend can co sponsor your family with them still being in another state.

2. You can print the form from the internet but it will need to filled out by him and signed. It is his income that will be looked at. And he will need to get it notarized by his bank or someone with notary abilities.

3. They did change the rules but to be on the safe side I would have three years of taxes. He can submit copies of his W2s. I photo copied my brothers taxes and then stapled them back just like they were submitted to the IRS. He will also need a letter from his employer verifying he is employed and in good standing. My brother also had this letter notarized.

4. I do not think they need this now. Maybe someone will say different here on the forum.

P.S. Make two spare copies of all of this. You will need one at interview time and one as backup if you have to resubmit it later.

You might want to check with the consulate about which affidavit to use for a K visa, or with other people who have worked on K visas with that consulate.

Only the consular officer who reviews your friend's information can tell you whether or not the friend will be an acceptable sponsor. At many consulates the answer would probably be 'yes' if all of the financials are OK, but a some consulates - Manilla comes to mind - the answer would probably be 'no'.

The USCIS has changed it's policy on tax returns for I-864, but frank_cuenca is not dealing here with the USCIS.

Nor, in all likelyhood, is he dealing with I-864.
