Confused about filing taxes

I know this has probably been asked before and I have searched but did not find the information that I need.

I need to file taxes and this is the first year where I am filing as married. My wife is still not in the US so I need to get a ITIN for her I assume.

I know I'm supposed to fill out the W-7 but it asks that I submit an original passport. How can I do that if she is not in the US? She has no American forms of ID, obviously.

I don't mind filing as married filing separately or jointly; whichever is easier.

All I know is that according to the IRS, putting "NRA" in the SSN column is no longer an option.

Any help is appreciated.

U cannot file as married since she don't have any U.S id, u need to file as single. And for ITIN, she needs to be here, it is a replacement of ssn. If she was dependant on you in America, then u could add her. But not now.

Really? Thanks. That helps a lot. I keep hearing that filing Single after being married is perjury.

No, people don't know, they just talk without knowing and scare other people. My husband dont have any US Id and I filed as single. This year I wanted to file as married but the tax person said u ll be in trouble if IRS checked that he wasn't here the whole last year.so I have to file single again.

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If your married you file as mfs or mfj. If NO ssn or itin you put NRA. Ssn or itin is required to file mfj.

We filed mfs with NRA our first year. The following year we submitted ammended return with w7 when apply for itin. Once we got itin we used that number for filing mfj. After arrival in usa and get ssn then notified irs and banks of change from itin to ssn.

Read IRS Pub 519 and page 14 of IRS 1040 instructions.

If your married you file as mfs or mfj. If NO ssn or itin you put NRA. Ssn or itin is required to file mfj.

Ammending from mfs to mfj once she has her SSN will be easier than doing the ITIN. We did the ITIN and ammended return because at the time we needed the extra funds. Tax benefits are worth the effort of ammending from mfs to mfj in situations where there is only one income.

Cannot file as single once married, though some get away with it. A way around is to prepare using MFS/MFJ/HoH, printing the forms, writing in NRA for ssn, and mailing the forms in.

You seem guilty of the same. There are ways to file being married while lacking an itin/ssn for taxes.
