Hi everyone,

I am gonna make my story very short and get right to the question.

My marriage is falling apart and I am trying to fix it with counseling and other things, but I feel that we will get divorced before the 2 years mark and I am getting ready to file alone with divorce waiver, but I have few questions if someone can help me please;

When I submit the package with evidence of a good faith marriage I will include health care power of attorney and other docs showing that I was sharing everything with my wife and some medical docs from our doctor showing that she is the person to contact in case of emergency too, my question is, showing such document is enough or they want also to see the document where she had my name as emergency contact for her? Everything I will submit will be ME giving her permission and power of attorney to do things related to me, will the USCIS care to see that she also had me on her stuff or not? If a divorce happened I may not be able to get these docs.

Another question, we have a joint phone bill, each month I download the bill and it shows both our names and the whole detailed bill. When I send this as a joint account, do I have to send the whole detailed bill or just the cover showing our both names and total amount?

I entered the US on January 2015 and we are still married this day and I have the following evidence, please tell me what do you think about it and if you suggest to collect more;

Joint car lease

Joint car insurance (2 Cars)

Joint phone bill

Joint checking bank account

Joint health insurance

Joint Dental and Vision insurance

Joint electricity bill

Joint apartment rent agreement

Joint care credit account

Joint Cigna saving plan

Joint BJ's membership

Joint purchase of a bed and mattress (Both names on the receipt)

Many photos together since January 2015 till now

Photos with her family on Christmas,Thanksgiving...

Holidays cards from her family to us

Birthday card from her to me with love letter

Welcome letter from her family to me when I arrived in 2015

Hotel reservation for 3 nights on our anniversary

Document from my work showing her as emergency contact

Document showing her as emergency contact at our medical facility and authorized person to call on my behalf and get access to my information

3 Sessions of marriage counseling (For now)

Please let me know what you think, Thank you.

Our marriage is real but it's just not working.

Sorry to hear about your troubles. Hopefully it won't come to a divorce.

But if it does, it seems like you have some good proofs already. I would highly suggest getting more "financial" types of proofs. Something like a joint bank account, savings account, 401K with you/spouse as beneficiary, etc. Those (in my eyes) are worth much more than lots of other types of proofs.

Good luck!

Thank you, I hope not too.

We already have a joint checking account and we filed taxes together for 2015, I have a Care Credit account and I added her on mine. I don't have 401K account.

USCIS generally likes financial evidence, taxes, family photos. I genuinely do hope you guys work it out but if not, it is good you're doing counseling, you may also include an affidavit that will discuss that you made efforts to make the marriage work. What about other bills like utilities? They like those too.

We have photos with her family on holidays. The only utility bills we have joint in the electricity bill, heat and water are under the rent contract so we don't really pay any other utility bills. I can get affidavits from my co-workers because she came with me to work few times and on other days she used to bring me lunch. Will that help?

Sorry your marriage is falling apart hope it works out for you guys. Either way you seem to have really good evidence even for the short time you've been here. Keep gathering whatever you can show, and yes you can add affidavits too. The advice they normally give when removing conditions with or without a waiver is "clear the kitchen sink." Very important especially with financials coz those weigh a ton when it comes to USCIS.
