Ok so I have figured out the I-485, I am now onto the I-864.

I am stumped by the very first section. The affidavit of support is to be filled out by my Spouse that is the US Citizen correct?

The first section asking Basis for filing affidavit of support: what should be selected for a K1 Visa?

Can these forms be anymore confusing?

Still on I-864

Part 5 where is asks for the total number of members in the house hold.

It carries over 1 from Part 3 section 28 - where it asks how many people are you sponsoring.

Then it counts the sponsor as 1, then it asks if the sponsor has any dependent children which there is 1.

It then asks if the sponsor is married - which is a YES because they are married to the person they are sponsoring, so this is a 1

Plus I count myself as 1.

This equals 4, when there is only 3 people in our house... Myself, My Husband who needs my sponsorship, and my child from a previous marriage.

Makes no sense... Am I missing something?

"Do not count any member of your household more than once". Stick a zero in the spouse box as he's already counted in the part 3 section 28 box.

It's so confusing, plus having to attach the marriage Lic. Why wouldnt they ask of the person you are sponsoring is your spouse?

Can you help with Part 1? For the K1 I wasn't sure what box to select?

DS-3025 is what I submitted and it worked for me. Here is the list of items I sent in for AOS/AP/EAD:

  • Payment in the amount of $1070.00 USD

  • I-485 completed and signed

  • Copy of applicant’s Canadian Passport biographical page and entry stamps

  • Copy of applicant’s K-1 Visa from passport

  • Copy of applicant’s NOA2 Approval Letter for I-129F Petition

  • Copy of applicant’s I-94

  • Copy of applicant’s birth certificate

  • Copy of marriage certificate (certified copy)

  • G-325A completed and signed

  • Two passport-type photos of applicant

  • Copy of DS-3025 vaccination documentation worksheet

  • I-864 Completed affidavit of support and supporting documents

  • I-765 Completed application for employment authorization

  • I-131 Completed application for travel document

Do I need to compete an I-131 if I have no travel planned? This form seems to looking for specific travel info outside of the US and I don't have any planned presently.

OK, on the Affidavit - We checked off box 1 A (So the USC fills this out and then uses 1A because they are competing the form for the immigration of a relative) - Because you are now married so you are spouses, and related.

For the I-131 - You don't have to, but I did. If you don't do the I-131 then you cannot travel until you get your green card which can be 6 month or many more. It is free to file it with AOS, but if you did it separately, it costs money I believe.

The forms are super confusing.. I think it is because they use one general form for all sort of types of immigration. Know what I mean?

For the License, they want proof that you are married because that is the reason you are legally allowed to become a resident.. so I think they need the official back up.

If I fill out the I-131 and don't put any travel info in it will they then send me something that states I can travel?

Yes, That is exactly what they will do. You get a card that generally is valid for 1 year. It can be used for multiple trips. There are sample forms for most of these on here. You should check them out. It will help you see what you need to do. That combined with following the guide and you should have no trouble.

When you put this together to mail it was all sent in the same envelope together? Did you paper clip stuff together?

What form are the 2 passport pictures for? the I-485?

Posted

Personally yes I clipped each form and its supporting documents together. I submitted 6 US passport pics ( 2 each for I 485 AOS / I765 EAD / I131 AP). Remember these pics needs to have been taken within 30days of your filing date. And just in case the clip loosens, I put each clipped form ( with supporting docs) in its own sheet protector sleeve (you can get from Walmart or any office supply store).

And yes all in the same envelope especially if you are filing for AOS/ EAD together.

Good luck
