Hi JVers,

Please help! Its urgent.

Here are short stories:

1. I, US citizen, married to B2 visa holder. I have filed: I-485, I-130, I-765 by lawyer. The lawyer messed up our paper work and each time his correction we have to pay a fees: incorrect filing for renew I-765. Suppose renewal I-765 using previous information and NO fees, instead the layer filed completed the new one with fees. It's rejected and need to resubmitted. Now waiting for approval. Any suggestion in this???

2. My current husband had a daughter and under age of 18 when I married him and she entry in U.S. as F-1, student visa. My step-daughter will turn 18 in January 2017. The lawyer only file I-485, NO other forms and paid $1,070.00. As this moment I'm realized that I need also to file I-130 as well as I-765. PLEASE advise for this situation. Do I need only continue to file I-130 for my stepdaughter or do I have to start at beginning? Re-file I-485 and other new forms? What's the procedures?

3. My husband and his daughter had missed their interviews due to not RECEIVED the letter. I know that because I checked online that USCIS scheduled. Their priority date 11/25/2014. Due to not have interviews on time what will happen to their cases? From then no letters or anything relate to their cases had received or noticed? What are the possibilities? Re-file all ? Please Help!

I'm very appreciate any feedback and recommendations.

1) Yes - fire your lawyer, because they're an idiot.

2) See (1), but also, what basis of eligibility did you use for the I-485?

3) When was their interview scheduled? Did you receive formal denials for their I-485s yet?

2) See (1), but also, what basis of eligibility did you use for the I-485? - I really did not know. Lawyer did not provided me/us copies. How I find out what basis of eligibility did him used for the I-485? Please suggest.

3) When was their interview scheduled? Did you receive formal denials for their I-485s yet? -- We did not received hard copy. But USCIS website indicated Jan 6, 2015. We did not received any thing yet.

You would need to see the completed I-485 to see what he marked down for your stepchild's basis of filing the I-485. I'm unsure as to how you managed to get that accepted by USCIS without filing an I-130 with it.

Was the I-130 for your husband also denied?

Was the I-130 for your husband also denied? --- For I-130, still pending as USCIS website case status. We did not received anything except the first I-797C.

Re-file your husband's I-485, enclosing a copy of the I-130 NOA since that seems to still be pending and wasn't denied.

File an I-130 and I-485 for your stepchild.

Obviously, stay well away from the lawyer who "helped" you the first time.
