My fiance was denied of his visa yesterday and my question is for how long can we apply for spouse visa. Thanks

Soon as you get the marriage certificate after you get married. Be sure to write a brief withdrawal letter and put on top of your I-130 petition package.

Did they say why they denied him? You are free to marry and file a cr1 but bear in mind it won't help if you can't over come the reason he was denied, people need to understand when ever you file a petition whether it was 10 years ago or 5 they are in the system forever, so when ever you file for a new or different petition they can see all your old ones and can or may grill you on them and they can even denie for misrepresentation or fraud on past petitions, this post is not to be discouraging but to inform this is a very tough embassy I suggest going through and read past post for marriage petitions here, as for everyone petitioning to bring your loved one I wish you Good luck! ?

Sorry to hear about your denial. I've seen some couples try the CR1 route after a K-1 denial and not be successful because they failed to fix the reasons for the K-1 denial. Personally I would file the K-1 one more time with fixed issues and a better evidence packet. Making a quick move to marry might be considered a red flag. Wishing you the best!

Thanks a lot! I don't think getting married is going to be red flag because we have kids together and besides they made us do a three way DNA for one of my kids. So getting married and filing for the Cr1 is the right way. I went to my senator and what they told him was we are legally married so we need to file for the 1-130

Why would they say you are legally married if you aren't? And why in the world would you go the fiance' Visa route when you have a whole family together that was a red flag there begging to be denied.

Just get married file the I-130 expect an interview in about 1 year from when you file. That's a realistic timeline.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

This is too much. Sorry for the denial. But what kind of pictures did you send over? Did they give you guys the option to appeal? If you have multiple kids with your fiance then you should have just done cr1...In any case as has already been mentioned, mary and make it public and then go for the cr. Good luck

We did not have any party and no bride price paid. That was the CO decision that she thinks we are legally married after DNA test and also redoing his medical and submitting his passport.That's the issue in Ghana.

Nosy neighbors or having family together is what led to that conclusion.

Some women in Ghana call their baby daddy husbands. And culturally, other Ghanaians conclude that you are married when you have children with a man and are on good terms with him. The issue of whether you are actually married only comes up when the man or the woman dies.

It is unfortunate but there are so many ambiguities in Ghana culture.

Get married and file I-130.

it is difficult to prove that you aren't married if everyone in the neighborhood including some of your family members believe you are.
