Hi,

Firstly thank you in advance for any advice.

I am a UK citizen and my wife a US citizen living in the UK.

My wife is currently submitting the i-130 this week through consular processing in the London embassy and we hope to hear back soon.

My question is regarding the i-1864 affidavit of support for the next part of the visa application:

She has been in the UK for five years now and as a result her bank accounts etc have been closed in the states.

We have a registered US address and will be moving in to her families house initially when we move over there. My wife has an offer of employment in the states that meets the minimum income requirements however we do not have any savings. Is it enough that she has a job offer to meet the requirements or will we have to have a joint sponsor who is already in the states.

My wife has not filed tax etc in the states so she is back filing and re-opening bank accounts / voter registration to show intent to move.

Any help would be greatly appreciated as this seems like a really grey area.

You are going to need a joint sponsor who is earning now.

Your "intent to domicile" is covered by the job offer. And filing tax returns is necessary because she needs to provide the latest one and information off the last three as part of the required documentation for her I-864. Sounds like you are moving in the right direction.

Thanks... That's what I thought but just wanted to make sure before I requested all the info of the joint sponsor.

Appreciate your time and sorry for the lack of ??? in the text realized it was quite difficult to see what I was asking.

If anyone has any info on what is needed to prove intent to move that would also be great?

You'll want to include evidence that she is taking steps to reestablish her life in the US. Sounds like you're to a good start. A few links for further reading, each of which has a section on domicile:
