HI Amjz,

I have started the court procedure, we also had to submit pictures, information of new school, new house, activities, provide statements about why we want to move etc. It certainly isnt a quick procedure as your fighting for court time to get your case heard. Im not trying to stop the father being involved in childs future, i still want contact to be there- its just the contact will be in blocks- i have granted a lot of hols. its up to the courts now.

Is the child a US citizen? I feel like there are some details missing with regards to that.

Does your wife have sole custody without visitation rights? If so, you can get an American passport without the other parent's consent. I've done it myself.

Yes the child, she is a U.S. citizen. She hasn't been back to the UK since leaving as a toddler. I hope she still qualifies for UK citizenship as she did have a uk passport. I know you don't automatically get British citizenship these days by being born in the UK. Not even having a British father is enough especially as my wife wasn't married to him when she was born too.

She has contacted the UK passport office so we will see.

Yes she is still entitled and should still be able to get one. The question is if she can use it. If the 'father' (I use this term loosely as any other word would probably violate forum rules). Put a block on her traveling, even traveling with a UK passport could cause issues. If she has had a UK passport, it's simple to put in a renewal. The issue being, she probably can't travel on it if there are court proceedings as it'd be breaking the law. When I was traveling every time I had leave of the court to do so. Because it's going though court at the moment! If I didn't have leave of the court I could be in trouble. I don't think they would have in my situation, but still it's a possibility and it does so state in my residential order. I'm allowed to travel with my daughter for up to 4 weeks unless I have permission from her dad or the court. Are they in the US? I don't know how US law works with this. In most situations in the UK the parent the child lives with can take their child out of the country with out consent as long as they are returning. In the US I do not think this is the case. However laws change on a case to case bases.

I'm sorry you have to go though this, it isn't an easy process with out the added stress. But you are doing everything you can.

The US doesn't prohibit you from having another citizenship, but in American, you have to be American. She shouldn't try to travel back and forth to the US as British. She could enter the UK as British, but she would need an American passport to show upon entering the US.
