CR1 and 864 Requirements

Hi All,

I am trying to get things done as my I-864 will be coming shortly. And I want things to be done ahead of time.

I have had nothing but grief with this part of the process. We have had our original co-sponsors (my parents) back out because they read all the paperwork and freaked out ...We now have another co-sponsor and I just want to have things clarified and made as simple as possible so there are no surprises again...

Does anyone know how many years of tax returns are needed for CR1's?

Is it simply 1 year or 3 years? There was a memo on the USCIS website dated 12/21/05 that stating that some visas no longer require 3 years of tax returns. However, I can no longer find that memo on their site.

If anyone has any experience with this recently, it would be of great help to us.

The insturctions for the 1 year of tax returns only apply to the USCIS regarding I-485 adjustment cases. They DO NOT apply to the State Dept and CR-1/IR-1 cases. So three years of tax return information will be required.

As of my wife's interview on 9 March 2006 in Manila, three years of tax returns (and supporting W-2s) are required for CR-1/IR-1 visas.

I was there and watched the embassy staffer open the file and verify that the documents were present.

I had copies of my 2005 return, but I was not asked for them. The 2004, 2003, and 2002 documents were adequate.

If you think you waited a long time for the immigration process, how about one YEAR to get I-130 approval (and then just add another year for the interview)!

For CR1's, you will need recent 3 years tax returns with copies of w2 for those three years. Also, you will need employment letter and recent pay stubs.

NVC Timeline

11/15/2005 - NVC case number assigned

01/04/2006 - NVC completed the case... ( 50 days)

01/11/2006 Case sent to Embassy

01/16/2006 Case deliverd to Embassy as per DHL tracking

February 7th, 2006 Found out Interview date by Calling DOS (202-663-1225)

February 13, 2006 - Packet 4 received

March 21st, 2006 - Medical

March 23rd, 2006 - Interview --- VISA APPROVED

March 24th - Passport received. ( Applicant picked up passport from Courier/delivery service office)

April 7th - Hubby's POE at Chicago.

April 10th - Trip to SSA Local office to apply for Social Security Card.

April 27th - 1st Welcome letter

May 1st - 2nd Welcome letter

May5th - Received Social Security card in mail

May 11th - Received Green Card in mail

196 Days @ USCIS ( 178 for NOA2 + 18 case transfer at NVC)

50 Days @ NVC to complete the case

13 Days @ case transfer at embassy

65 Days @ Embassy

Total -324 days from NOA1 to Visa approval

My wife and I were not asked for pay stubs or an employment letter.

My wife is a student and I work for the U.S. government as a civil servant. The W-2s apparently contained all the information that the U.S. Embassy required.

After waiting one year for I-130 approval (approved in February 2005), the NVC completed the case on 1 September 2005. The interview occurred just over 6 months later.

The best part of the time required is that my wife will not be a conditional permanent resident when she arrives in the USA. We had been married for over two years before the NVC completed the case.

If you think you waited a long time for the immigration process, how about one YEAR to get I-130 approval (and then just add another year for the interview)!

Thanks for all that great info...

I feel like this part is the worst of it...last year I lost a business, and it killed my income for 2005.

Finding a co-sponsor has been by far the most stressful part of this. People see that agreement and pull out. Nothing was worse than when my own parents decided they wouldn't help us. It broke my heart.

I did not send an employment letter or pay stubs to the NVC. Just the W-2s and the tax returns. The NVC forwarded the documents to Manila and they were in the file at the time of the interview.

Perhaps co-sponsors must send those documents, but I did not require a co-sponsor.

Don't forget the Joint Sponsor's proof of US citizenship (or LPR status).

The insturctions for the 1 year of tax returns only apply to the USCIS regarding I-485 adjustment cases. They DO NOT apply to the State Dept and CR-1/IR-1 cases. So three years of tax return information will be required.

Im not so sure about that any more zyggy. When the new rules first came out it definately appeared as if it was only for adjustment cases. However going by the newly released U.S. Department of State Foreign Affairs Manual Volume 9- Visas and what has appeared on the US Embassy Manila website it may indeed now be including those applying for an immigrant visa at posts abroad.

This is an extract which is highlighted on the actual document.

(4) Certified copy of completed most recent federal tax return with all

supporting schedules that the sponsor had filled prior the time of

AOS signing. Each return must have all pages in the correct order

and must be stapled together.

Additionally, petitioners (or cosponsors, if needed) filing an I-864 AOS are required to submit ONLY ONE YEAR'S TAX RETURN, CURRENT AS OF THE DATE THE SUBMITTED I-864 WAS NOTARIZED (this is a change from the previous requirement of submitting tax returns from the three most recent tax years).

The actual signed and notarized I-864 AOS must be an original copy. However, faxed copies of tax returns are acceptable.

I would however suggest having 3 years until such time that this is stated in the instructions recieved from NVC with the I-864.

I just noted a post in the DCF forum that the US embassy in Australia is also now saying that only 1 years is required for immigrant visas. What doesn't seem clear at present is from which date that an I-864 is signed and dated does it apply to. With adjustment of status, from memory, it applys to I-864's signed and dated after 15th April 2005???
