Hello everyone. Please i need help to give my second child the amercian nationality.

I am an american by birth. But i never lived in the states. My parents are lebanese holding a british passport. I got married in 2009. In 2010 i gave birth to a beautiful baby girl, she was born in Lebanon. immidiatly i applied for for I-130 and got immigration visa to the states. We traveled and by entry my daughter got the unconditional green. card. After spending a month in Texas we came back home and i applied for her passport at the embassy and she immidiatly got her US passport.

the problem now with my secind child, i gave birth ti my son in 2012 also in Lebanon. I did the same procedure all over again. My son got the immigration visa, we both visited the states and after he got the unconditional green card. But the problem is that the embassy can not issue him a passport. He needs certificate of citizenship. And all files require that the parent or grandparent should have resided in the states fir 5 years 2 of which after the age of 14. Unfortunatly i can not meet this requirment cause niether me nor my parents resided in the states. I have my grand father and my aunt and uncle who are american and reside in the states. What can i do??

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

1. A Certificate of Citizenship is not necessary to get a passport. Proof of US citizenship (in this case, the child's green card + proof of parent's US citizenship + proof that child lived in the US with that parent) is enough. Not sure what is the deal with this embassy. Maybe they don't think the child really resided in the US with you? Maybe they don't think your "visit" counted? Maybe it would be easier to apply for the US passport in the US?

2. The stuff you are saying about grandparent or physical presence are completely irrelevant. You may be looking at the INA 322 (N-600K) process. But that is not what you are dealing with here. You are claiming that your child became a citizen automatically while in the US under INA 320.

Thank you for ur reply. As for the N-600k i can nit apply for it. So you advise that i travel to the states and go directly to the passport office and apply for his passport, right?

Well the thing is, it should make no difference where you apply, because the rules are the same. You are saying he derived citizenship by living as a permanent resident in the US with you, which already happened. It's the same thing that happened to your first child. Maybe the particular person you talked to was confused or something. I would first try applying with another staff person and make sure they understand how the child got citizenship, rather than take a family trip to the US.
