I received the formidable RFE today. The request was for evidence that my previous marriage has ended and that my Fiancee's previous marriage has ended. It also goes into great length about foreign documents needing to be translated with a statement by the translator that it is true and correct along with credentials. The problem is that I submitted all of this.

Now I am wondering if there was incompetence and they lost my paperwork or if they are having a hard time with the documentation. The request is for documents that I already provided.

My understanding is that when the paperwork originally is sent to the Texas service center they claim the check for our payment of bad customer support and that they scan all of the documents. Is it possible that they did not scan everything or that they attached it to someone else's petition or that they just lost the paperwork in the scanning process? What else might they have missed if they missed these prominent documents?

On the other-hand, my divorce decree has a digital time stamp and digital judges signature which is now the standard for my state. (Divorced two years ago.) They did say that wanted to see a decree signed by a judge or magistrate. What do you do when your state does not provide a hand signature but a typed digital signature? Secondly, my fiancee's divorce degree is contained within her marriage certificate. She is from Brazil and they add the divorce decree into a paragraph of the marriage certificate which also shows her name changed back to her maiden name. Confusing, right?

So which is it? Incompetence or they don't like the documentation provided. Anyone had this happen before?

Lastly, they telephone number they give out looks like the National Customer Service Center's number. Can these individuals look up or get someone to verify the documents are missing or provide clarification?

Obviously, I fear sending the same documents and having them reject my petition. It's not like we all aren't anxious to get married and we want to prolong our engagements!

Sorry for so many questions. I may be over analyzing, but in my world incompetence is unacceptable!

It's NOT sent to Texas service center it was sent to the lockbox and that is not the same as the service center.

And it is humans who deals with it, and they can make mistakes and so can you.

They are looking for a divorce decree with the stamp or seal from the clerk of courts.

Similarly they are likely looking for a separate document showing the beneficiary's divorce.

I would suggest the you dismount from your high horse and obtain a different style copy of your divorce decree (if it exists) and submit that. If it's not possible then include a cover letter that explains what is issued in your state. Also in the cover letter explain / point out that the beneficiary's court adds the divorce decree to the marriage certificate. Be sure that the copy that you submit has a complete translation attached.

Perhaps your documents were misplaced. Or perhaps they are not in a common format. Keep the big picture in mind (obtaining the visa) and send in what's needed.

Also, posting exactly what the RFE says can be helpful as other members may have had exactly the same issues. The details are important. Scan the RFE (block out the appropriate info) and post it here.

I had the same RFE 5 years ago, I've sent you a message, I can tell what your fiancee

needs to do in Brazil.

Wondering...is there a reason you can't post the solution here, so that others that find themselves in a similar situation might also benefit?

For anyone still reading this: yes, it's possible that they lose paperwork and then issue an RFE, it happened to me. I received an RFE asking for all the documentation I'd already submitted.

I re-submitted identical information (using copies where I no longer had an original), and received my green card in the mail a few weeks later ... (Not even requiring an interview.)

Now, they will not admit or explain to you that they've lost forms. (In fact, the person issuing the RFE may not know *why* the forms are missing, he just doesn't see them. Don't assume bad intentions.) If you are unsure about your case, this is a great time to consult a lawyer just to check your paperwork. But if you're thinking "these RFE make no sense", then they may have lost it. In my case, the RFE repeated the generic language from the instructions of the form I submitted.

Before you flame uscis, remember that this agency has to manually process ungodly amounts of paper arriving in the mail all the time. It's bound to misplace something occasionally. It sucks if it happens to you and causes a delay, but don't panic and respond in a polite way.
