Tips on filling taxes non resident married to citizen

Hello guys,

I am a non resident alien, used to be on OPT F-1 till 21st of december 2015 and switched to an EAD that I got when I applied for my green card (which I am still waiting for).

From what I have read online, it seems like since I am married to a us citizen, we can choose to make me a resident for tax purposes and file jointly. Is that correct ?

If yes, what forms shall we fill out ? where shall I do my taxes ? ( possible to use big names like H&R block...etc ).

Yes, there is an election statement to choose to be treated as a U.S. resident for tax purposes for an entire year. See this link for more info on that election statement: https://www.irs.gov/Individuals/International-Taxpayers/Nonresident-Spouse-Treated-as-a-Resident

I wouldn't really recommend the big block offices like those... I'd recommend more of an independent tax professional. Just make sure you ask if they are versed on this subject and/or are willing to do the research to prepare a correct return.

Thanks for your answer Maria. But if I am a resident for tax purposes then shouldn't it be actually easy to file ? Why would I need the help of an independent tax professional ?

Is there anybody that has been in the same situation that could give me advice ?

Well, you did ask for advice and I gave it. If you're considering going to a "big name" company like H&R Block - good luck. I've heard nothing but horror stories from my clients that have gone to them in previous years. Not to say you won't come across someone knowledgeable, but at least in my experience most of my clients come from a bad experience with HRB and JH.

This site is geared towards a DIY and with that said most around here will suggest TurboTax, so try that option.

If you think your situation is pretty easy, then by all means go for it and prepare your own return.

What I am wondering the most is that since my F1-Opt ended on the 21st of December, and that I am using my new EAD that I got while still waiting for my green card. What is my current status? Am I still non resident?
