Hi,

I'm filing my AOS , I'm married to a USC and have 2 children from a previous relationship and 1 with my husband here. I have a couple of questions..

1. Do I file the same paperwork for my kids as for myself?

2. What Application Type am I on section 2 of the I-485 form, I will be filing my I-130 at the same time if this helps.

3. I received a caution (I wasn't arrested but basically told off by the police) when I was 16 for a juvenile prank where a 'friend' shoplifted into my backpack. I did a police check as I was sure it'd show up and wanted to be ready when they asked about it. Well I got the check back and it says 'no information held about you' in the Police National Computer. Now I don't even know what to do, should I check yes and explain that I wasn't arrested but warned or check no and forget about it? I want to be honest but I don't want to bring up something irrelevant that will harm my application.

Any help would be greatly appreciated :)

04/02/2007 - Mailed I-485 & I-130 for myself and 2 daughters

04/10/2007 - Package received at MSC

04/16/2007 - NOA received for myself and 1 daughter

04/18/2007 - NOA received for other daughter (delayed by incorrect address).

04/27/2007 - Biometrics scheduled - arrived 2 hours early due to overcautious husband, let us go in early and were all done 15 minutes later.

04/30/2007 - All touched.

06/21/2007 - All touched.

06/28/2007 - Initial interview scheduled for all.

06/28/2007 - All approved with stamp.

07/02/2007 - Received Welcome letters.

07/03/2007 - Received card production email.

2. I don't understand this part, you said you will file I-130 with I-485? What type of visa do you have? K3 or K1? Are you already in the US? If you're in the US with a K1 visa, you need to file only the I-485 after you got married, and you check C on Part 2 of the I-485 form. If you're on a K3, an I-130 and I-129F should have been filed before you enter the US, no need to file I-485.

3. I'm not sure how to answer this. If I were in your situation, I would disclose it, but that's just me.

I'm currently an overstay on a B1 visa, living in the US with my husband & 3 kids (2 also overstays & 1 US born). We are going for our medical today :( hopefully my previous TB shot when I was a child won't show up as positive.

How would I disclose the caution? Should I check no and add a written explanation?
