In need of advice after RFE for AOS.

Hello!

In need of some advice on what my next step is for my case. We filed AOS with NOA date Sept. 23, 2015. We received a RFE asking for the medical examination I-693 on Dec. 1, 2015. We sent our reply with the new sealed envelope from the civil surgeon and was delivered on Dec. 28, 2015.

The last update on USCIS case checker was on Sept. 23 for "Fingerprint fee received." Strangely the RFE came from the Barrigada, Guam field office.

I don't know why I'm not getting any updates or notifications about this case, I have no idea why we ended up at the Guam field office. No issues at all with the EAD/AP. Received updates via text/email and checking the site. All approved no issues.

I understand that the case checker can be unreliable and not updated regularly. It's worrisome that I have had no updates at all other than the RFE letter in the mail.

The RFE has a deadline of March 1, 2016 with failure to submit the requested documents by the deadline will result with our case being denied.

Has anyone had a similar situation? Any advice/input is greatly appreciated.

I have not experienced this situation but I will offer my opinion based on my education and personal experience. I will assume that your response to the RFE was tracked and the package was signed for - this way you have acknowledgement that the package was received and signed for. Sorry, but the next and only step is to wait for a response... Patience! It is learned.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Submitted the RFE in December and USPS confirmed delivery on December 26th. Since then, nothing other than my EAD/ AP getting approved in January. For my I-485, it still states that an RFE was sent on November 27th and hasn't been updated since. Like you, I worry whether the form has actually got to the right department. I tried calling USCIS and the lady I spoke with said she didn't have access to that information and said I should make an infopass appointment if I was worried. I tried sending a USCIS Service Request online, but that just comes back as "case is within normal processing times".

It would be nice to know that they had actually received the RFE so that I can know that something was actually happening with my case.

Hello! Have you tried to ask a TIER 2 officer when you called them? Maybe him/her can tell you something about your status. As far as I know, they can have access to the cases, not just read what they see in the system. In my opinion, it is important to know where is your RFE, however it can be a failure of the system. Good luck!

2016-02-01: Service request sent regarding EAD

2016-02-02: Service request was sent to an officer for response

2016-02-11: Second service request sent, assigned to an officer same day
2016-02-12: EAD/AP card is being produced!!!
2016-02-17: EAD/AP card is being mailed!!!

Hello! Have you tried to ask a TIER 2 officer when you called them? Maybe him/her can tell you something about your status. As far as I know, they can have access to the cases, not just read what they see in the system. In my opinion, it is important to know where is your RFE, however it can be a failure of the system. Good luck!

Thanks, I will try to speak with a tier 2 officer. So far I've also only heard that it's still within the normal processing times and to just be patient.

Thanks, I may try that next week. Can't do it on Monday as it's presidents day so they'll be closed. Getting concerned now that my I-485 case status hasn't been updated for coming up to three months, and nearly two months after sending in the RFE. Seeing other November filers getting interviews and green cards makes me anxious just to see some movement on my case :cry:
