Timeline

I recently returned to the US and I have been living at my parents house for the last two weeks. I was out of the country for all of 2015 so I will be using my dad as a joint sponsor. I will be moving out of my parents house within the next month. Should I have my dad fill out an I-864 or I-864a? Now we are part of the same household but within a month we won't be. I am going to send the AOS package within a week. Thanks.

Timeline

For the purposes of the I-864, a household consists of people you would list on your tax return plus any minor, unmarried, children. It does not necessarily mean people living in your house.

I assume that your dad has not listed you as a dependent on his tax returns...and vice versa.

You would need to complete an I-864 as the petitioner and your dad would complete another I-864 as the joint sponsor. If he filed joint taxes with your mom, then she would need to complete an I-864A. If your dad's income is enough to sponsor by himself then your mom would not need to complete an I-864A. Simply providing a copy of his W2s to evidence his share of the income would suffice.
