Hello,

I really appreciate all the help you guys have provide on this forum, as i have learned so many things about the process by reading people answering other people question.

To give you a quick scenario about my case. I recently completed my DS-260 and submitted the form yesterday and i plan to send out the AOS Package and IV package monday if i can. So here is my question

My wife is from India and she has been living there since birth. We got Court married in May and she filled for a new passport and she received it in September or so. My application is under the married name so thats good in a way. My issue is about PCC. We got the PCC from India passport office which was very easy.

She was out of country for 11 months in 2013. She was sent to norway from her company for a project . We have already filled for PCC for norway but that is taking too long and i really dont want to wait anymore. So i am confusing is that do i really need the PCC from norway. It is seems like USICS stats that i dont need since she didnt live there for 12 or more months, but one of the lawyer mentioned to me that yes she will need for any stay over then 6 months.

So can you guys clear my confusion? Thanks alot!!!

But the website said completely opposite of it? I mean it Travel.state.gov website. They wouldnt post wrong information?

Not sure if i am allowed to post outside link or not but it the website link - https://travel.state.gov/content/visas/en/immigrate/immigrant-process/documents/Supporting_documents.html

As you see it says From you Country or previous residence if you were at least 16 years of age and resided there at least 1 year......Kinda confusing, she was not official resident of norway, she was on work permit visa there. So i dont know how to break this down..

Yes, you're right. She doesn't need a police certificate from Norway. It's neither her country of nationality nor country of residence. If it were, then she would need one since she lived there for more than 6 months.

It would be considered a country of previous residence for which she would need it if she lived there for more than 1 year.

Do you guys think if i submit without Norway PCC they will send me RFE and ask PCC? I just dont want to lose anytime tbh!! Norway has claimed they have mailed the certificate over a month ago so i am not sure whats taking so long to arrive to India.

What you guys suggest here? Wait for it or submit it without the PCC?

If they say they've already mailed it then I would say just wait for it. Submit everything once you receive it. Why don't you ask them if there's a tracking number.

Your wife is back in India, correct? If so, she needs a police cert from India. Since Norway is not her country of residence and she lived there for less than a year then no, she does not need a police cert from Norway.

@Teeak - Thats what i am doing waiting it out for few more days as of now. until i saw response form Mallafri.

@Mallafri - I totally agree with you that i only need a PCC from India and which we have already but from what reading stuff online the NVC sends out RFE for every small reasons. So i was thinking that just i wasted this many days for form not required for my application so why not wait out till weekend and send it out by saturday.

All i am worried is that i dont want to see any RFE from NVC..

You don't need it for Norway but yes, if you're unlucky, you could get an NVC rep that "interprets" the rules as needing one even though that's wrong. I would say the chance of that is very small, but it could happen.
