2nd interview surprises and potential issues

My Thai Fiancé just had her 2nd interview. After a lot of tactics and sweet talking my fiancé some historical issues that my fiancé was not proud of surfaced.

Apparently as a masseuse 8-10 years ago she had taken invitations from customers to go out after work and party. This ended in sometimes intimate relations. 3-4 "clients" they factor from what she testified. This when it comes down to it is prostitution. It is a huge surprise to me and I am still trying to wrap my hands around it. My love is being tested for the first time.

So 1st interview she said no to this answer and signed no document.

2nd interview she spills her guts and tells the truth (which hurt us, but I am proud of her to say). Mind you this was 8-10 years ago. She is not proud of it and was young and dumb (17-18 years). It didn't happen often as she never promoted it. She was young, single and it would start out as just having fun. Of coarse she has regretted it for sometime and now more than ever it is hurting us both.

They had her sign a form that

she couldn't really read, and cannot explain to me what it was. Close as she can explain is that it was stating that all of what she had said was the truth. She signed it.

They took her passport which may or may not be a good sign. There was some mention of a stamp but she didn't understand everything that was said.

I am not sure exactly what she had to sign but can assume it was after she swear the oath.

I am hoping she doesn't get flagged as in-admissible to the US.

I will begin research on the 601 form I have heard about in case. This will require a lawyer and likely cost us much money and we won't make my departure timeframe of Feb. 20th.

I know this is a not so sensitive question when it comes to the masseuse employment here.

Anyone have a similar issue on here.

Taking the passport can be a good sign. If by stamp they were talking about the visa, very good thing. I am unaware of any other type of stamp they would place in her passport but maybe someone more knowledgeable than I can chime in. If they are giving her the visa then you will make your 2/20 departure date. Good luck.

How long ago was the 2nd interview? When my wife interviewed, her passport was delivered with the visa 3 days later via EMS in her village in Lopburi.

Unfortunately I wasn't there as designed. But they used sell your body, and classified these acts as a "client" from what she could clearly tell me. She said to the officer they gave her salary, or what she means by that is money for support. She never initiated the act of selling herself (put a price on her body of asked). More so she thought they were nice to her and accepted to go out and have fun like a movie, dinner, dancing after. This lead to multiple other "dates" as she saw them to be. She took these as opportunities to find a husband and a better life for herself. These were not men who as she felt just treated her as a prostitute and never contacted her again. If that was their intent or not I am not sure. She traveled to Pattaya, and on most other occasionswebt out locally in Bangkok. Also to be clear she was never with more than one man at any point during these dates. This is over 1-2 years for age 16-18. Yes as you can see she was technically underage at the time as well.

But what historical records on the subject I hear these are red flag type situations that they are trained very thoroughly to ask about during the interview if employment is massage. I am just researching these type of questions. They did not provide her any paperwork and I can only go off what she is interpreting for me. But from what I can research most all interview candadites who claim they do massage in Thailand the officer immediately asks these type of rude questions over and over.

US has a policy directly stating to not allow applicants into the country if they knowingly sold their body. This is where they classify prostitution. I am just worried the officer flagged her as such. The 2nd interview took 2 hours which is very long compared to most interviews I have researched, especially as all our paperwork was considered okay and they never asked for additional paperwork. But as soon as she stated massage, bang. Non stop questions over and over again about selling your body. They had no other questions for her during the entire interview.

All we can do is wait for now. I can't see how I can talk with them to be sure they understand this correctly. She is scared they may be taking how or what she said incorrectly.

And if a second interview is normal. From what we have been seeing and all the interviewers I have met over the past 4 months it seems to be happening more and more. Most of these second interviews are due to they asking for more information. But even many like ours was not due to this. Only when she mentioned working as a masseuse when asked about employment outside of the 5 years that was provided on the paperwork.

Since the employment document only asks for the past 5 years of employment. Like I said originally. We claimed she did not work for the past 5 years, or more accurately she was self employed farmer for rice, and more over a caretaker to her whole family. She is legally listed for her grandfather for support. The government pays an amount each month for his bad hearing, old age, and health problems. This support requires someone like her to be listed on his paperwork. She is also the youngest sibling and ther is a Thai tradition that she be the one to fill this caretaker role if available at that point in their life (married/not married, has child or not, has job away from home or not can waive this tradition). Since she was never officially married or had children at the time of her grandfather and mother who has a heart condition got sick she decided to leave bangkok and take care of them.

After that she did have a child with her ex never officially married husband. This grounded her from working away from home as well for the last 4 1/2 years. 1 1/2 of which is our relationship. The father has not been a part of the child's life as he left her to be remarried due to him sleeping with an underage girl which means he must marry her or be sent to jail for up to 25 years. He was very bad to her and their son before this incident and just made the divorce from the un official marriage easier. Though at the time of the divorce she didn't know the situation he put himself in. Rather he wrote her off as being a bad wife and they were not good together. It was just recently in the past year he remarried to the underage girl. (He is 27, the under age girl is thought to be 15-16)

We just have to wait and see what happens. As the petitioner I really feel blind to what is said and what is answered at the time of the interview. I understand this need at the time of the interview, but now it being after I feel it should be my right to know this information to be sure what she said after being interrogated was accurately stated and interpreted by the officer. She felt the officer may have tricked her, twisted her words, or even in her higher state of fear she herself didn't say exactly the right words.

Oh and her and interview was today. I am posting this as live as I can. Our first interview was Jan 27th, her second interview was today Feb. 4. I have to be back in the US at latest Feb 20.

Like I mentioned, the EMS motorbike showed up at our house 3 days after the interview which was good as our flight was the next night. I do not have any experience in the area which you are now encountering. However, I wish you all the best and I hope to read in 3 days time that you got the passport back with the visa inside.

Thank you. This is when I expected to hear back as well. I have been extending our stay week by week. I hope to hear more by this next Tuesday-Wednesday. It is 2/7 Sunday 5:56pm here in Thailand. I can stay as long as 2/20 at the very latest. I have not purchased any flights yet as I want to be sure we have a seat next to each other. I cannot purchase any open tickets or insurance tickets for 1 way.

I believe you can check your status on the nvc websight, it will say "issued" when the visa is in the mail.

Yes I have been checking daily at: http://ceac.state.gov/CEACStatTracker/Status.aspx since our first interview. They don't update it that frequently. We are staying in Bangkok. I have a funny feeling they are going to want another interview or even a joint interview. It is Sunday. I hope to have more notice in 2-3 days. Thank you.

We decided to head back to her village and have spent the past 4 days with her family.

I have brought in my congress woman Julia Brownley to see if there is anything her office can do. We have not received any updates and I am set to fly back in less than 2 days. It's going to take a miracle to get this in time. She has been quite emotional this past few days. Hope to hear something soon. We are packing to drive back to Bangkok now. Thank you.

We just got the first response since our 2nd interview. They want her to go back for a 3rd interview. I have been researching this everywhere. Does anyone have any information about a 3rd interview. Thank you for any assistance you may have. They didn't say to bring any additional information. They just said to show up.

wow, 3rd interview means they may go either way depending on what you say. i would advise that these relationships be described as "geeks" rather than clients as much as possible

We checked the website and it is marked as "refused". We don't know why it was refused and there is no information we can prepare for before the 3rd interview. I have prepared a letter to change her statement from the 2nd interview as I have a feeling the interviewer had her put down "clients" on the form she signed and this is likely why they refused her. I am hoping they will allow her to change her statement as she was forced to sign this form stated how the interviewer told her to write it. She said she never sold herself but they claimed she did. These are relationships she had as boyfriend and girlfriend. Although she met them through work. At no time did she sell herself, any money that was given to her was for safe transportation, food, or support for her while they were away from each other. Even though these men may have had other intensions she had only tried to meet a good man to better her life. I do understand how this all sounds although she may have been stupid at that age and immature to see what may have been going on with their intensions she never sold herself willingly. Never asked for money.

If that is the issue holding us up I hope to get this cleared up. If they don't believe us we will have to submit a waiver form to show hardship for me not having her here in the US.

Unfortunately it states in the code not just convictions on prostitution but if you admit to it they can use it. I am hoping this form she signed didn't legally convict her of these actions.

I am thinking I have to get a lawyer involved now.
