Filing a petition for undeclared children

Timeline

My aunt acquired her citizenship through marriage with a US citizen, but when she first applied for her green card she didn't declare her children in the Philippines.

Will it still be possible for her to file a Petition for Alien Relative?

 OUR TIMELINE :jest:

K1 VISA/SSN/DL....:wub:

  • 03/07/2016 - I-129F Sent
  • 03/10/2016 - I-129F NOA1
  • 06/04/2016 - I-129F NOA2
  • 06/27/2016 - NVC received
  • 06/30/2016 - Case number assigned
  • 07/01/2016 - NVC left
  • 07/08/2016 - Consulate received
  • 07/18/2016 - Interview date
  • RESULT: Approved! :dance:
  • 08/12/2016 - Arrival (POE: Los Angeles Airport)
  • 08/20/2016 - Got Married :wub:
  • 08/29/2016 - Applied for SSN/Got my SSN card
  • 12/16/2016 - Applied for DL - (I was told to wait until they verify my status and will send me a letter)
  • 01/11/2017 - Got a mail stating that I can apply for a DL ;) and Passed the knowledge test 
  • 02/10/2017 - Passed Driving Exam / Received a temporary DL.
  • 02/22/2017 - Got my DL with 6mos validity. :wub::wub:

 

AOS, EAD and AP APPLICATION

  • 10/11/2016 - Date filed (AOS, EAD and AP)
  • 10/25/2016 - NOA date
  • 11/08/2016 - RFE AOS
  • 11/23/2016 - Biometrics taken
  • 11/28/2016 - RFE sent
  • 12/05/2016 - RFE notification received.
  • 01/12/2017 - EAD card is being produced and AP approved
  • 01/13/2017 - EAD approved.
  • 01/17/2017 - received NOA (AP) in mail 
  • 01/18/2017 - New card mailed
  • 01/21/2017 - Combo card received!
  • 02/25/2017 - AOS status changed from "Request for evidence was received" to "New Card is being Produced" 
  • 02/28/2017 - AOS Status changed from "New Card is being Produced" to "Case was APPROVED!!!" :jest::jest:
  • 03/01/2017 - AOS Status changed from "Case was approved" to "Card was Mailed to Me"
  • 03/03/2017 - GREEN CARD RECEIVED :D

Hi OliAnne. I would like to hear about your concern. Did your auntie was able to petition her undeclaired child? I have the same issue here. Your answer will be a really really big help for me. Thank You.

Our problem is I did not declaire that i have daughter when i file for my green card. Is your husband declaire his son on his aos or when he applied for visa? If it is, that will be really great hope for me. I regret not declairing her and did that for some reason. And now i really wanna be with her.

Hi Allysa, we have the same issue here. Well, I have 2 boys but I did not put my youngest son on the k1 visa. I told my husband about my youngest son and he forgave me and accepted my son. If you will check the Regional Forum, Philippines. I posted a topic,  "Youngest son not listed in K1 visa" on Feb 22. And so far I got positive responses from our VJ families. I feel relief now and my husband is ready to file a petition of my boys. We will probably undergo the DNA test but I don't mind a bit just to prove that he is my son.

Im happy for you and im happy that i have a big chance to get my daughter here. I also read that you need a proof of your relationship like birth cert like that or the DNA. But i also read that you will need to explain why did you not declaire your relatives. Some of the response i hear from here is we need to hire a lawyer but We already know how to file for a petition because we already been thru the process, i am really looking forward about your case that is the same as mine. It really gave me a big hope and not to worry too much about not being with our love ones.

Hi Paula , I hope we can get thru this. I still did not start the petition for my child as I am afraid that I will get denied and get deported due to the administration right now. I am not sure how are we gonna do it. Please let me know if you started it
