Hi I quit my old job on March 2015. Went to the philippines On April 2015, Got married and Went back to california on September 2015 I started my new job on october 2015. I make $10 an hour. I know that's not enough. So can I make my dad as joint sponsor? He makes more than 40k in a year.

Early 2013 - Confessed our love for each other * Late 2013 - I got pregnant with our daughter
2014 - Our baby was born in Athens, Greece and completed our family. We now have two boys and a girl!! 2013 - 2015 - Looking for jobs in Greece, none were available (due to socioeconomic crisis) 2015 - Decided only way to feed our family was to immigrate and started the process December 2015 - Got married (Greece has a LOT of red tape for foreigners marrying Greeks)
January 2016 - Finished gathering all documents and getting them translated
* * DCF in Athens, Greece * *

28th January 2016 - Finally filed I-130s
29th June - ISSUED!!!!!!1st July - Visa packages and passports delivered to DHL.4th July - Visas in hand! CU in two weeks USA!!
19th July- POE Detroit. All went well!! (excluding our screaming, jet lagged toddler!!)

 

After Arrival in the US

September 2016 - Hubby is diagnosed with congestive heart failure
October - February 2016 - Battle with drug use, overdosing, bringing home a tiny paycheck

March - July 2017 - I am working 80 hr weeks to make ends meet. Discovered hubby's affair. Still overdoses and is hospitalized. Has quit working all together.
July - October 2017 - Marriage counseling. Revealed hubby has "several" mental conditions. Is started on several mental meds.

October 2017 - Got accepted for a college course. Got better job to help raise my kids.

October 2017 - March 2018 - Situation at home is toxic. He files for divorce.

July 2018 - Divorce is final. I have full custody of our daughter.

 

ROC (GC expires July 19th 2018)

July 16th - Package for ROC is delivered to the CA service center (divorce waiver).

August 30th - NOA1 received with 18 month extension (fee waiver approved).

March 28th 2019 - Biometrics

August 8th 2019 - Case Approved No RFE No Interview - 10 year GC in production

N400 (Online - Detroit, MI office)
June 6th 2023 - Applied for naturalization under 5 year rule.
June 7th 2023 - Application received/Biometric will be reused.
June 16th - Interview scheduled.
July 27th - Upcoming interview.

around 5k

My mom is working also. And so is my big sister. So i think my younger sister is his only dependent.

It is a little more complicated than that. His wife counts as one for his household size, then if your big sister is married she will not be counted. If she is, she will be counted from what I understand. Then your younger sister. That is a household of at least 3. That is about 25k.
Since you are only making 5k and the limit is 25k, you are 20k short.
Your co-sponsor must prove he has the 20k times either 3 or five... so between 60k and 100k to support his household plus your wife, in assets.
So it would seem his income of 40k is not enough BUT if he owns a house, cars, bonds, stocks etc that could be liquefied, to meet the requirement, you are good to go.

I might be a little off in my numbers though but this is the gist. Including his two daughters and wife and your wife, it would make it a household of 5... which is a steep increase in available assets :(

It is a little more complicated than that. His wife counts as one for his household size, then if your big sister is married she will not be counted. If she is, she will be counted from what I understand. Then your younger sister. That is a household of at least 3. That is about 25k.

Since you are only making 5k and the limit is 25k, you are 20k short.

How to count household size >

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ,

My sister files for her own tax.

my mom counts too? she files for her own tax. Can my husbands assets in the philippines counts too?

Wait... let's start over here and forget the assets for now...

Since your father is a joint sponsor, the CO will not be looking at your income whatsoever (you will still need to provide an I864 and financial evidence). They will instead look at the joint sponsor's income.

Your father's income is 40k and he has 2 dependents (his wife and your sister). That means he has a household size of 3. When we include your husband, we need to check if he earns enough for a household size of 4. According to the poverty guidelines, he needs to earn a minimum of $30,312. Since you say your father earns $40k, he makes more than enough to joint sponsor. No need to include assets.

*Edit: One of your posts say your sister files her own taxes and is not included in your father's. If so, your father would have a household size of 2 plus your husband for a total of 3 on the I864. He definitely earns enough to sponsor.

Ok, great. Then he definitely earns enough to sponsor. He has a household size of 3 plus your husband for a total of 4. He earns more than the minimum requirement of $30,312 so it won't be necessary to include or count assets.

Why are you including any assets in this? The father makes more than enough for a household of 4 to joint sponsor the beneficiary.

Also if your mom works she can add her income to your father's with an I-864a so that they combine income. In fact if they file their taxes together, I recommend they do this.

if my dad will file me as his dependent. will his income enough to support 5 households?
