How re-enter US if one-year GC AOS extension expired while I-751 processing is delayed

Timeline
  • Filed for AOS in early June 2015. Received one-year GC extension (through May 2016).
  • USCIS (Vermont) now (Feb 2016) only processing March 2015 packets (which I swear they were doing last Sept. when I first inquired about the delay).
  • Wife wants to travel to home country in June 2016 and come back in August, but i-751 AOS may not be processed by then, and the existing one-year extension will have expired.

What can we do? Can she get some kind of new Advance Parole card just for re-entry?

Can she get another extension, and if so, how, and how will the airlines in her home country know it is good when matched up with her seemingly-expired GC (she's worried about this since they wouldn't be experts on U.S. immigration status and probably don't know much English anyway -- the extension letter works fine for renewing her drivers license, but maybe not at foreign airports)?

Any help or information would be much appreciated. Thanks!

Hold the show! :protest: Are you speaking about I-485 Adjustment of Status (AOS) or are you speaking about I-751 Removal of Conditions (ROC). These as two different steps in the immigration process, and you seem to have mixed things up a bit, between your initial title posting and the content of your post. It would help if your timeline was filled in. :idea:​ Please clarify your exact immigration situation. :yes:

It's Removal of Conditions, of course, not AOS. It's been 7 months and I forget what we're doing.

Anyway, I'll try to come up with a timeline but re-post with actual facts.

It's Removal of Conditions, of course, not AOS. It's been 7 months and I forget what we're doing.

Anyway, I'll try to come up with a timeline but re-post with actual facts.

If that is the case, then make an InfoPass appointment with your local USCIS office and get an I-551 stamp in the passport (as mentioned in response #3).

Thanks for the generous help. I've made great use of VisaJourney throughout the process and never had a hitch until now and have never posted anything. I apologize and will try to clean things up to help others.

Briefly, here's a timeline (I don't know exact details at the moment). I can tighten this up soon and include in profile:

Feb 2012 – K1/K2 approved

July 2012 – Arrived in U.S.

Sept 2012 – Married

Jan 2013 – AOS Applied for

xxx 2013 - AOS Biometrics accomplished

Aug 2013 – USCIS appointment, Green Card (2-year) granted

June-Aug 2014: Everyone traveled to Russia and returned, no problems.

June 2015 – ROC applied for, 1-year extension granted (to June 2016)

June 08, 2015 – ROC Biometrics accomplished

. . .

Sept 2015 – Was told Vermont was working on March 2015

Feb 4, 2016 – Was told Vermont was still working on March 2015

June-August, 2016: Wants travel to Russia and re-enter. One-year extension will have expired and ROC perhaps not processed by then (given slow pace).

I take it we should make appointment at USCIS office and get this I-551 stamp in their Russian passports if it comes to that. I believe I want to do this 45 days prior to expiration of the 1-year extension?

Anyway, that sounds like the best first step, and I thank you.

When we were waiting for ROC adjudication (akin to watching paint dry... :lol: ), and were in a similar travel plan situation with the extension letter expiring, I was looking starting the info pass appointment step 90 - 120 days before the letter expiration date. Depending on the USCIS office, there may not be many open appointment times available. Suggest that you get it done early, minimize surprises and stress.

As it turned out, right before the 120 day window opened, we got a RFE for more "marriage bonafides." Took us a month to collect and send in another close to four pounds of paper in response to the RFE. Our ROC was approved a week after receipt by USCIS of the RFE response novella. YMMV.
