What last name to use when filing I-485

My wife came here on k1 visa on November 1st. We got married on December 18th. Now we're working on AOS.

I have a question concerning which last name to use on all the forms. The one on the marriage certificate or the one on her birth certificate, her maiden name.

She changed her last name to my last name when we got married. She then changed her last name to my last name at the social security office.

I just want to make sure everything is good before I send the package in.

well, you two get to choose ...

the only side-effect of having a green card NOT in passport name, is that you have to purchase all air tickets for out of usa travel in passport name, and bring a marriage certificate to show the name linkage at a POE when re-entering.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

When I applied for AOS, I had legally changed my name to my husband's last name. My LPR card does not match the name in my passport (maiden), and I haven't had any problems until last October when the Munich Airport officials decided to give me trouble for it. Homeland Security has never batted an eyelid about it. I didn't carry my marriage certificate ever, until now.

So it's up to you. If your wife plans on naturalizing, I would recommend using her legal name (married). There have been a number of people on the N-400 forums complaining about their processing taking much longer because of the name change.

07/22/2014 - 11/14/2014: 116 Days from Application Received to GC Received.
Naturalization
02/03/2016 - 05/31/2016 : 119 Days from Application Received to Oath Ceremony.
