Hi all,

I am a Canadian, married to an American, living and working in the US on TN status, and about to apply for Adjustment of Status for Permanent Residency (Green Card).

My wife is filing an I-130 for me. We'll do a concurrent I-485, I-131 and I-765.

It's the I-765 that I'm confused about. Four questions:

  1. At the top of the form, it asks "I am applying for...". Do I select "Permission to accept employment"? I assume my TN doesn't count as an employment authorization document but wanted to be sure.
  2. Question #15 asks for "Current Immigration Status". What should I put? I'm here on a TN, but I put "TN Status" for #14, and I assume the answer shouldn't be the same.
  3. In terms of additional documents, when it asks for I-94, is it my most recent one (the last time I entered the US) or the I-94 when I was first granted TN status?
  4. And is there further backup documentation (besides I-94, passport bio page, and 2 photos) that I need to include with the I-765? Do I need a letter from my employer? I've seen mixed opinion on this, but none seem to address TN to GC specifically.

And one separate question:

When filling out the I-131 Advance Parole, do I need to list a date of "intended departure", or can I leave that blank?

  • 2/5/2016 - Sent I-130/I-485/I-131/I-765 to Chicago Lockbox via FedEx
  • 2/9/2016 - FedEx confirmed delivery
  • 2/16/2016 - Received NOA1 for all documents (via e-mail and text)
  • 2/26/2016 - Received notice of biometrics appointment for 3/7/2016
  • 3/02/2016 - Walk-in biometrics appointment completed
  • 4/12/2016 - E-mail notification of I-131 and I-765 (card ordered)
  • 4/22/2016 - Received EAD/AP Combo Card
  • 09/14/2016 - E-mail notification of interview date
  • 10/17/2016 - Interview
  • 10/17/2016 - E-mail notification of I-485 approval
  • 10/24/2016 - Green Card in hand!

Yes. Permission to accept employment, regardless of whether you've had an EAD before.

Yes, TN.
