Good afternoon,

I apologize in advance if my posting is in the wrong place but I am new to VJ. Please feel free to move to correct thread/forum.

I'm a US citizen applying for my husband. Had interview for I-130 at local field office in Detroit, Michigan on December 1, 2015. Got approval notice in mail on December 15, 2015.

Waited 30 days as stated in Approval Notice. Called NVC and ask for my case number and they have been telling me for the past 3 weeks that there is nothing in their system. Almost 2 weeks ago, I Sent an e mail to nvcresearch@state.gov and nvcinquiry@state.gov with a scanned version of approval notice attached to the e mail along with my name and date of birth as well as my husbands name and date of birth in body of email.

Out of frustration and calling NVC with no new update for 3 weeks, every single day, I called USCIS was told I need to wait 90 days for them to look into the matter and call back after the 90 days have passed. After insisting that the gentlemen please transfer me to someone who can help me find out where my case is, and litterally almost crying on the phone, he must have felt sorry for me and thankfully transferred me to an immigration officer. Told officer all that I've stated above and how nvc is telling me that they are not showing anything in their system with my receipt number, the immigration officer said that texas service center probably didnt send approved notice to nvc and that she will send a reminder to Texas service center which will state that the petitioner (me) has been calling NVC and that more than 30 days have passed from the time period specified on approval notice and to send/resend approval notice to NVC. She also told me I will get a response from USCIS by March 3rd (30 days.)

I don't understand why this is happening and why USCIS never sent my approved case to NVC if that's what really happened. I asked officer if she can check if my case has been sent to nvc but she insisted that since nvc is saying they have nothing in their system it means that my case hasn't been sent there. Anyone have any advice or has been thru this before?

I thought the long waiting was over after finally getting an approval after 1 long year of waiting! I didn't think I'd have to wait again some more just to get a case number so that I can move on and proceed to pay fees and the rest.

I thought the hard part was over. I'm Anxiously waiting for case number so I can proceed with payment, verify my case is at correct consulate/post and submit any docs needed to nvc so I can leave michigan and go be with my husband as we'd wait for an interview appointment together.

By the way, when I filed my i130 petition I actually included wedding photos, marriage certificate, birth certificates passport bio pages for myself. Then on Dec 1st in my interview in detroit, I submitted my husband's passport bio page as well as lease copy with both of our names and police clearance forms which is dated Aug 5, 2015. Do you all think this could be a reason for a delay? Since I sent them in before asked to do so? just thought it'd be easier and quicker to pre-send them. So all I have left to send in to NVC whenever I hear from them, which i PRAY is soon, would be payments and affidavit of support as well as visa application form.

So sorry for long posting but I've been reading all of your posts and you all seem to be there for one another and help each other out which is awesome! Thanks in advance for any assistance/advice :)

call into uscis again,

get an iso [immigration service officer], not the first human that answers the phone, and put these questions to him/her:

1. where is the casefile today?

2. has the adjudicator at my local office finished with the casefile?

3. is the casefile still at the local office?

4. why hasn't the casefile moved from the local office to NVC ?

5. did the local office finish up with the scanning of the casefile, or no ?

----

all of the answers to the above are findable, if'n the ISO will read the electronic notes in the casefile.

I called uscis and spoke to ISO and asked what u stated. Unfortunately, the officer could not see anything in the system/case notes except for the approval notice being sent out on the 15th December. She stated that nothing else is showing; where the case is , if it left field office or not, etc. She did put in a service request and also advised that I make an info pass appointment (which I had already done for next wednesday,) to get further information. So frustrating. I don't even know what the heck is going on!

Just got an e mail from Texas service center followup that they replied to the many e mails I sent them last week. Any thoughts on what the heck this means and why it was relocated to records facility?

"Hello,

We have received your service request and researched the status of your case. Our records indicate that since the date of USCISs last action, your file was relocated to a records facility. We have requested your file back to our service center for further processing of sending it to NVC. Please allow up to 60 days for receipt and the service center to forward your file to the NVC.

We apologize for the delay and any inconveniences it has caused.

What You Can Do

Please see the "Online Services" below to check the status of your case in the future.

We hope this information is helpful to you."

so it smells like the uscis local field office sent the approved I-130 casefile into the National Records Center, by mistake.

It also smells like the order to move the casefile from NRC into NVC was sent.

If you get into the local USCIS office again via an infopass appointment, try to get confirmation that the casefile actually left the National Records Center.

IMO, the local field office screwed up, and it's on them to fix their screw-up. If you bring attention to it, in person, face to face, and not leave until you have talked with the shift supervisor about this, you might get some traction into the next phase.
