- Recommendation Sent (to USCIS) August, 31 2016

- No Objection Statement Received July, 22 2016

- Fee Received July, 19 2016

- Form DS-3035 Received July, 19 2016

- Form DS-2019 Received July, 19 2016

- Passport Data Page Received July, 19 2016

- Statement Of Reason Received July, 19 2016

Still haven't heard from USCIS.

It took me about 20 days to hear from them with a US address. With a Brazilian address, it took me 30 days. - All after the recommendation was sent.

After a lot of stress and irritation, my case has finally got approved - and I'm sure it was with the Brazilian Consulate's help. So, If you are Brazilian and your No-Objection waiver is delayed, I strongly suggest contacting them. Here is my nightmare-material timeline:

Filed DS-3035 with the DoS: 03/03/2016

Obtained the No-Objection Letter from CAPES: 04/28/2016 - They are so messed up that I needed to beg for my mother to beg them for the letter. I was trying to obtain it since early February.

Obtained the No-Objection Statement from the Brazilian Government: 05/02/2016

All Documents Received by the DoS: 05/19/2016

DoS granted Favorable Recommendation: 06/22/2016

USCIS received I-612 (Filed by the DoS, no need to file yourself in a No-Objection case): 06/27/2016

USCIS NOA1 issued: 07/06/2016

------> Here comes the 61 day nightmare<-----

USCIS Approval: 09/07/2016

USCIS NOA2 Arrival (to an US Address): ?

Just an update to the timeline:

Received the Notice of Approval through the mail (US Address): 09/12/2016

Hey guys,

so clarify something for me please, i am having a hard time deciding when we should start our process.

I was in the Science without border program too and i need to apply for the J1 waiver and K1 visa.

Can I apply for both at the same time?

Do i need to wait for my letter from Capes to start the processes?

I also worked on my IR immigrant visa before the Waiver. My interview happened in Rio de Janeiro on February 25th this year. My visa was approved but not issued because I need the Waiver.
I paid for doctor examinations before the Interview. My doctor examinations expire on August 24th. So, because I didn't get the Waiver I didn't get the visa too and I will need to redo the doctor examinations again. I asked the U.S. Consulate in Rio de Janeiro to take the doctor examinations now but they replied saying I can't do anything before my Waiver is sent to them.
I hope they won't ask me to go to Rio de Janeiro again. The Consul Officer told me that the Interview validity is 1 year.
Rio de Janeiro is so far away from my city and it is so expensive every time I go there.
Take your NOA1 with you to your interview with a copy and leave the copy with them. I didn't tell them my case number of my Waiver process in the DoS and they sent my passport back to me 2 weeks ago with a letter asking me to apply for a Waiver.
Now I need to get the Waiver, send it to them, go take my doctor examinations, send the examinations + passport to them and wait for my visa!
I can't wait for it to be over!

I really suggest you to apply for the visa just after your contract with CAPES is over. Then you will have the no-objection letter from CAPES.

Apply for your waiver before you apply for your visa.

I applied for my waiver first than for my visa but I applied before getting CAPES letter then they scheduled my visa interview long before I got my waiver. It ended up with me having to redo the doctor examination. So, I wasted time and money by not having patience to wait for CAPES letter to start my waiver then visa application.

I have a quick question, I applied for J1 Waiver under the "No objection" and now i'm in the process with the USCIS waiting for I-612 approval. Can I travel inside U.S.? if so, which document I need to use at the check point ?

May 24 ---- J1 Waiver cashed the cashier check for the process fee
May 27 ---- No Objection letter sent from Mexico's consulate
June 20 --- E-maill from J1- Waiver "THERE IS NO RECORD OF HAVING RECEIVED YOUR APPLICATION"
July 12 ---- No status on webpage
July 13 ---- J1 Waiver respond "PLEASE REDO OR RESEND APPLICATION PACKAGE. REMEMBER TO CANCEL CHECK FROM THE FIRST PACKAGE AND SEND A NEW PAYMENT FOR THE PROCESSING FEE"
July 14 ---- Resent 2 packages
July 15 ---- Package was delivered
July 19 ---J1 Waiver visa specialist sent an e-mail: "WE HAVE NOT LOCATED YOUR WAIVER PACKAGE AS OF YET. YOUR PACKAGE MUST FIRST GO THROUGH PROCESSING AT THE WAVIER DEPARTMENT IN ST. LOUIS, BEFORE BEING SENT TO WASHINGTON, DC. FOR THE COMPLETION OF THE PROCESS. ONCE IN WASHINGTON, DC, THE INFORMATION WILL BE ENTER ONTO THE SYSTEM SO YOU CAN CHECK THE STATUS. . It's so weird.

Contacted with USCIS. And they haven't got my case yet from DOS.

I dunno what should I do?

Do NOT worry.

In my case

DOS send the Favorable Rec to USCIS on 6/26

USCIS received it on 7/5

But I did not know about it until 8/3 when USCIS issued a receipt number.

So the time between DOS sending to USCIS and USCIS issuing a receipt number can be longer now (6 weeks in my case), it the past it was hust 3-5 days.

I did 10 days ago. But no respond.

And my k-1 visa interview will be on 13th of October. I mean it really sucks.

Here is my slowest timeline. Not receipt approval yet. Will file AOS EB-2 after the waiver.

Obtained the No-Objection Statement from the Government: 01/11/2016

All Documents Received by the DoS: 03/18/2016
DoS granted Favorable Recommendation: 06/28/2016 (Receipt # came 6 weeks after this, in the meantime I contacted USCIS 10 times, but they could not find anything. SO I went crazy till Aug 3rd. )
USCIS received I-612 (Filed by the DoS, no need to file yourself in a No-Objection case): 07/05/2016 (Did not know this until Aug 3rd, when I received the notice)
USCIS NOA1 (Receipt Number) issued: 08/03/2016 (7 weeks passed already but nothing.)

I know it is going to be done in the end. But my concern is related with my k-1 visa interview.

I dunno what's gonna happen if it won't be done till that day.

Probably they gonna say" ok go home, come back later once you are done with your waiver" and that means struggle to find out open slot for my visa interview again. Maybe another medical examination. Another visa application fee and etc.

Hello guys,

Just wanted to update you all with my current timeline of No-Objection Statement J1 Waiver, even though I am extremely disappointed by this time/energy consuming process.

  • All documents received by the DoS: June 2, 2016
  • Received Favorable Recommendation: July 5, 2016
  • NOA1 from USCIS: July 12, 2016
  • Online Inquiry Sent to USCIS: August 25, 2016
  • Answer about inquiry: September 2, 2016
  • USCIS Approval Notice: September 21, 2016

It took 72 days for them to simply approve my I-612, it was frustrating. On my inquiry, I stated that my process was taking longer than expected, which actually was, and they answered me saying that on September 2 they were currently processing applications from July 10 (??????????????). If I can count right, they took 19 days to go through applications of July 10 to July 12 (day that they got my process), and that sounds extremely disturbing. Anyways, my last move was to contact the Consulate of Brazil in Washington in September 15, which had a perfect assessment of my case and they contacted USCIS about it on the SAME DAY. They got an answer 4 days later and the USCIS said that my case was currently with an officer and that a decision would be issued within 30 days - that sounded really bad at first.

Along side that, I am filling for K1 visa, and I had my interview without the answer of the Waiver Division. I had the exams done and the interview done as well. I sent them my waiver via email (a copy of the internet page), which was pending, and I am hoping they can finish my process soon. Once I get the actual letter, I will send them a copy, if they haven't processed my visa yet. Let's hope for the best. Wish you all good luck.

How did you submit an inquiry? Everytime I used their online tool it says that the application is within normal processing time? It has been almost 2 months at uscis since receipt number.

How did you submit an inquiry? Did you use the tool in https://egov.uscis.gov/e-Request/Intro.do ? And selected the "outside normal processing" option ?

Because, everytime I used their online tool it says that the application is within normal processing time? It has been almost 2 months at uscis since receipt number and 3 months since DOS send it to USCIS.

And I am also suprised that your Consulate in DC helped you. I wonder whether there is anyone got similar help from their Consulate. I think if if try to contact my consulate, they will pretty much say they do not have anything to do after sending No Obj letter to DOS.
