I-140 inquiry for long processing time

Hi Everyone,

forgive me if this subject has already been discussed here.

I submitted 1-140 and I-485 concurrently in March 2015. Fingerprinting done in April and I received my EAD in June. Since then there has been no change in my case status. My lawyer submitted an inquiry for me on Dec 01, 2015 and we received an notice that our case was assigned to an officer because it was taking longer than usual and to expect a response in 60 days. It has now been 60 days with no change. At this point should I continue waiting or should I contact UCSIS on my own? My lawyer told me that the only thing further I could do is pay for premium processing.

There is no such thing and no such cost. What center did you send your application to? CSC? VSC? Processing times are longer than usual for everyone lately.

Yes, there is such a thing as premium processing -- mostly applicable to employment based petitions.

Oops! I swear they said they were applying for the I-130, not an I-140. My bad OP. There is premium processing that may apply to you. (Thank you teeak for pointing out my error!)

There most definitely is a premium processing and fee associated with such through USCIS. When paying for premium processing USCIS has to adjudicate the case within 15 days of receipt.

My issue is not with the fact that premium processing is a thing, it's whether or not I should pay for it given that it's already been so long. I hate the thought of paying $1000 for something if it's only going to take a couple weeks more anyway. I would like to avoid that if there's another option available to me.

Hmm, the USCIS published processing times say it takes 4 months to process I-485 based on employment based applications.

You also have the option of contacting Senator Schumer or Senator Gillibrand of NY. They have links on their website where they can inquire with immigration (once you sign consent forms) about pending petitions.
