My EAD has changed from "Name updated" to "case was approved". I am so so happy.

So my EAD and AP was approved today. Hoping to get the combo card.

Mailed EAD/AP - 2/24

Bio - 3/11 (early walk- in) Appt 3/22

Approved EAD/AP - 4/19

No status change on GC.

Hey everyone,

I'm getting a little worried seeing all of these mid February filers like myself start to get interview dates or AP/EAD and I still have not received any news after they received the birth certificate they requested as part of the RFIE on March 31st.

To all the filers that got an RFE - have you received any update beyond the receipt notice and if so what are your dates like?

What I'm most worried about is if the RFE stops the clock on the EAD/AP processing.

Any insight would be appreciated. My stomach is in knots daily wondering if I'll get another RFE or what will happen now I'm totally thrown off on what to expect for timelines.

RFE does stop the clock for the processing until the response has been received and they have updated your file. From their website:

"

• If USCIS issues a request for initial evidence, the 90-day regulatory timeframe will start over from the date USCIS receives the initial evidence.
  • For example, if your case is pending 60 days when USCIS issues a request for initial evidence, and you respond 30 days later, the “clock” will be reset to Day 1 on the date USCIS receives the evidence.
• If USCIS issues a request for additional evidence, the clock will stop the day the request is issued and resume from the same point when USCIS receives the additional evidence.
  • For example, if your case is pending 60 days when USCIS issues a request for additional evidence, and you respond 30 days later, your case will be processed with the clock resuming at Day 60 on the date USCIS receives the additional evidence."

As Abby said, yes it does stop the clock on the EAD/AP as well. If you have an emergency that falls in the following categories:

• Severe financial loss to company or person;
• Emergency situations;
• Humanitarian reasons;
• Nonprofit organization whose request is in furtherance of the cultural and social interests of the United States;
• Department of Defense or National Interest Situation (Note: The request must come from an official U.S. Government entity and state that delay will be detrimental to the Government.);
• USCIS error; or
• Compelling interest of USCIS

you may qualify for an expedited AP. I would make an infopass appointment to check if USCIS will expedite AP based on your situation.

I received a rfe because one of the forms I used was not the right version. It was requested 30 days into my case and I sent the evidence 3 weeks later. Does this restart my application time frame to day 1?

From what I understand a RFE for I-485 doesn't effect EAD/AP as they are processed separately. You can file for EAD as soon as you arrive if you want and before you're even married so evidence for the I-485 doesn't affect it.

Yes that's why everyone sends it together to save that $400, I was just saying I don't think it starts everything over. It may delay it for the time it takes to get the evidence back to them but shouldn't be another 3 months from other people's experiences I've seen. At least I'm praying it isn't!

Was it a request for initial evidence or a request for evidence? That makes a big difference in the timelines.

From another VJer: "If the EAD was filed concurrently with the AOS, everything is on hold until the RFE is satisfied and the case resumes processing. The EAD in this case is derivitive of the AOS"
