Hi guys!

We recently filled my i130 to move to the US. My wife is a American citizen that has been living abroad for 4 years. She has not filled US taxes since she left. Now we do have a Joint Sponsor who meets all the requirements. Will my wife still need to provide her US tax returns? And if so, what can we do? Bit in Panic mode here!

If your wife has been earning money abroad, then she was likely required to file taxes. Your wife should file her back taxes ASAP.

Okay will get her to do that. And IF she wont be able to Sponsor me for my visa thus, having a joint sponsor must she still show proof of her tax returns?

Yes, she'll need to include the tax returns to evidence that her income doesn't qualify to sponsor hence, the joint sponsor.

As the petitioning spouse, she will be the primary sponsor. This means that she'll fill out the I-864 and submit the papers that go with it. This is the case even if you have a joint sponsor.

The IRS website has more information on the income threshold for when USCs are required to file. If your wife was required to file taxes for the years she was abroad (required if, e.g., her income was above a certain amount), look into the Foreign Earned Income Exclusion so that she doesn't pay taxes a second time on the same income.

You should make sure that you read and understand the Streamlined Filing Procedures for delinquent returns as well: https://www.irs.gov/Individuals/International-Taxpayers/U-S-Taxpayers-Residing-Outside-the-United-States

They are fairly straight forward and are really geared for making sure people properly file their tax returns. I just went through it and like others have said, if your wife has been earning < ~$100k a year or > ~$100k a year and paying foreign taxes in excess of the US rate, there will be a zero tax bill. I-864 requires the most recent tax return, but recommends providing the last 3. The last 3 is what you need to complete if you are delinquent too.

While I am a US citizen I have not been in the US for years.

I have ONLY one thread of my own and this is the 2nd thread other than my own that I have ever posted in here, (this question, in a thread that seemed on point but finished).

The other one of two threads I've posted in had nothing to do with me whatsoever but was helping someone else.

I have not mentioned this question anywhere else.

Check your facts before slandering others and making an ### of yourself!

It's people like aaron2020 that stop those like myself and others from asking questions we really need help with! I have enough stress right now and asking questions that are met with such hostility just turn me away. I thought this site was here to help people but I guess it's just a microcosm of the world as a whole.. Sad but true...

What if the US citizen petitioner and beneficiary (who are married to each other btw) have only been working as online freelancers and have not filed taxes?

Early 2013 - Confessed our love for each other * Late 2013 - I got pregnant with our daughter
2014 - Our baby was born in Athens, Greece and completed our family. We now have two boys and a girl!! 2013 - 2015 - Looking for jobs in Greece, none were available (due to socioeconomic crisis) 2015 - Decided only way to feed our family was to immigrate and started the process December 2015 - Got married (Greece has a LOT of red tape for foreigners marrying Greeks)
January 2016 - Finished gathering all documents and getting them translated
* * DCF in Athens, Greece * *

28th January 2016 - Finally filed I-130s
29th June - ISSUED!!!!!!1st July - Visa packages and passports delivered to DHL.4th July - Visas in hand! CU in two weeks USA!!
19th July- POE Detroit. All went well!! (excluding our screaming, jet lagged toddler!!)

 

After Arrival in the US

September 2016 - Hubby is diagnosed with congestive heart failure
October - February 2016 - Battle with drug use, overdosing, bringing home a tiny paycheck

March - July 2017 - I am working 80 hr weeks to make ends meet. Discovered hubby's affair. Still overdoses and is hospitalized. Has quit working all together.
July - October 2017 - Marriage counseling. Revealed hubby has "several" mental conditions. Is started on several mental meds.

October 2017 - Got accepted for a college course. Got better job to help raise my kids.

October 2017 - March 2018 - Situation at home is toxic. He files for divorce.

July 2018 - Divorce is final. I have full custody of our daughter.

 

ROC (GC expires July 19th 2018)

July 16th - Package for ROC is delivered to the CA service center (divorce waiver).

August 30th - NOA1 received with 18 month extension (fee waiver approved).

March 28th 2019 - Biometrics

August 8th 2019 - Case Approved No RFE No Interview - 10 year GC in production

N400 (Online - Detroit, MI office)
June 6th 2023 - Applied for naturalization under 5 year rule.
June 7th 2023 - Application received/Biometric will be reused.
June 16th - Interview scheduled.
July 27th - Upcoming interview.

What if the USC spouse was not required to file taxes due to not earning anything?

I believe if that's the case the USC spouse will need to submit an affidavit of explanation detailing why he wasn't able to generate an income.
