Hello all,

I have read over some of the other AOS VWP postings but would like to add a question: What is good evidence to provide showing that we did not intend to adjust status on the VWP? When do we submit it? How should it be formatted?

My husband (then fiance) came to america with the intent of us getting married, having a small honey moon, then returning to his country (Korea). I planned to go shortly after him as I had a very promising job lead in Korea. We both had flights booked, I was expecting the job offer at any time. Unfortunately, it did not happen and I am now going to be working stateside, and he has re-scheduled his return flight to after the 60 day mark so we have time to think. In short: We had the intent to get married, but the intent to leave a few weeks afterward and apply for the normal CR-1.

What we are most worried about is the fact that we got married shortly after his arrival to the U.S. which could look bad on the application. However, I have documentation about my job offer and its retraction, our flights, and my new potential job that is processing.

Timeline:

dec 24 2015 - he arrived

jan 1 2016 we got married

jan 31 2016 - his original fly out date to Korea

feb 14th 2016 - my original fly out date to Korea (Company interested in me said I would be starting "late feb~early march")

March 10th - his new fly out date to Korea if we do not file for the AOS

Can anyone offer any input on this matter?

sounds like you have great fodder for a letter of attestation. Practice writing it all out in paragraph form, then when yer ready, submit the big packet.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Unnecessary. Intent on its own is not a reason to deny AOS for an immediate relative (USCIS policy). Have a look at my signature. I was never asked about intent.

Darnell: I have not found a specific format, for a letter of attestation. Is there an official format or is it free form and included in/with the packet cover letter?

EM_Vandaveer: Congrats on becoming a citizen! While I know it is probably not necessary my husband and I would rather include an explanation up front to preclude any delays or issues.

My husband just received his 10 year Green Card after adjusting from VWP. As stated above, we never included a letter to explain that overstaying wasn't the intent, nor were we asked any questions about why he decided to stay at our interview.
