The childrens father is currently taking care of them with the help of my grandmother and other siblings. They are making it work best they can, while she works for 2 years in kuwait. So 6 months "vacation" is nothing compared to that. Any way, thank you all for your input. It appears the best action is to get my father here, then have him apply for my sister soon as possible.

Going by the Instructions for I130, all we need is the form itself, my birth certificate and my fathers marriage certificate to my mother. Anything else i would need. He doesnt currently have a passport so were going to start working that this month.

How would she explain to a CO that she needs to leave her children and husband for 2 years to work as a maid but she can afford to vacation in the US for periods of 6 months? So "vacation" as the reason for the visitor visa is questionable under these circumstances. I am not trying to be mean, just trying to get you to look at it from the point of view of the CO who would interview your sister. This is why this idea is unrealistic.

If we can get my father here, then the period of time granted for my sister to visit wouldnt matter. Just as long as she could visit time to time.

what role would your father play, that your sister would do ? or vice-versa ?

Ultimately I wanted to get my Sister and her kids here so they can have a better life. Even with her providing for them by working in kuwait, they dont have much. So getting my father here to get my sister here faster will have to do. And bringing my father here so he can have a better life as well. We lost my mother to sickness over 10 years ago and he never remarried. When i first posted, i didnt know it would be easier to get my father than my sister. So it appears we have a lot of paper work and alot of fees ahead of us to get my father and then my sister and her children. But if the timing is right, we should be able to get her and her chilren before they turn 21. If not, then atleast the younger of the two.

Another question i have is, can we apply for my father a work permit with his I130, or do we need to wait till his I130 is approved and he is in the US?

for him to file he needs to be in the US. When he arrives he will get a stamp in his passport that may be used to file. He will need to be living in the US for a petition for your sister to work. He can't file and leave.

lol obviously we wouldnt have him just show up to file for her and leave. We intend to have him stay with us for a very long time.

Well certainly as far as the sister is concerned you are looking at the 2030's so a lot is theoretical.
