Regarding 2015 Tax information - if your interview is prior to April 15th.....

If the USC has already filed 2015 taxes, the beneficiary needs to have a copy of the complete tax return (1040 or 1040EZ, plus forms that prove income such as: W-2, 1009-INT, Self-employed income), and an updated I-864 or I-864EZ, at the interview. If a tax transcript is available, that is better than the tax return.

If your interview is prior to April 15th, and the USC spouse HAS NOT FILED, they (normally) cannot ask you for 2015 tax returns. I do understand that some countries do try to jump the gun and require them, however. But the LAW says taxes must be filed by April 15th. Not any earlier.

In all cases: If the USC or the USC co-sponsor has an income that is VERY close to the poverty level, be ready to prove that 2015 numbers are above the 125% of the poverty level. W-2s are often handy for this. If the USC or co-sponsor is comfortably above the 125% of the poverty level, and has had steady income for the past 3 years, you will probably not be asked for it.

OR

If your interview letter specifically asks for 2015 taxes, then be prepared to give them exactly what they ask for.

The boilerplate sentence about bringing updated tax information is only 1) if you have filed 2015 taxes already or 2) if the USC or the USC co-sponsor filed an extension for 2014, and now has an actual 2014 tax return or transcript.

Do not volunteer tax information at the Embassy or Consulate unless you are specifically asked for it. Have it with you, but don't hand it over until you are asked for it.

Best of luck to all of you!

Hi

Got the DS-260 confirmation letter on 02 Dec, 2015 from USDS and asked us to make the payments.

Our Lawyer did the payments and submitted the receipts to NVC.

We were awaiting and awaiting for NVC to complete the case.

But when we called NVC on 5th February (after our holidays) they said our paid receipts were with them but not the application.

Our Lawyer said they sent it already for sure but anyway, they had sent a copy of the application to NVC again on 6th February and got the acknowledgement from NVC on 8th February.

Because of these issues our case has not yet completed or interview date is not yet scheduled.

we are confused.

Congrats for the interviewees!!!

I'm confused also. What in the world did your lawyer do? Sending payment receipts? NVC doesn't need that.

Let me ask when was your AOS and IV packages sent? Your scan date?

And what do you mean they sent a copy to NVC. The DS-260 is submitted only online.

Have you logged into the ceac.state.gov site to see what has been done? Click on DS-261 that screen shows everything needed. For you since you have lawyer DS-261 isn't needed so should have I believe NA but what does it say for DS-260? Should say complete.

Hi guys! I am sorry, I know this topic has been beaten to death but I need one more wack at it! Taxes 2015 - :)

Our interview is March 24th, and I am the petitioner and filed my taxes for 2015. I know now I have to harass my lawyer to fill out a new I-864 (AOS) form so it reflects my 2015 tax return (so my hubby will have it at his interview). My husband will also have my 2015 1040 and W2's, our tax transcripts from 2014, 2013 and 2012 (he will have that just encase too). Question is do I have to update my letter from my employer as well with my 2015 income year amount, it is about $1,765 difference since last year and this year. I am assuming yes, but before I go through the hoops of talking with our HR again, just want to make sure. Thank you!!

Just left the embassy I got Approved , I will write details later Thank You to everyone !!!

WOOHOO!!! Congrats :)

No need to translate. If original documents are in the language of the country where the embassy/consulate is, you don't need to translate.

if you want to make 100% sure, go to your embassy/consulate specific guidelines and you can confirm there.
