hey guys,I would like to know if it is okay to get a wrritten agreement from my Roomate stating that myself(USC) and my spouse shares the bills of the rent and utilities with him To prove we living together because my spouse and I names are not on the LEASE agreement but we have been sharing the apartment and bills with my roomate. Any suggestions would be welcomed.

Yes it's ok. It's not gonna carry much weight though and it's not gonna prove that you and your spouse live together. Anyone can write a letter stating that someone lives at their address. What about your driver's licenses, don't they have your current address on them. That might not prove much either but would definitely be better than a statement from a friend. What about trying to get some of the bills in your names instead of the room mates? Do you and your spouse have a joint bank account? If not, get one and obviously have the account registered to both of you at your address.

Yes it is ok but I agree with the previous answer it won't carry much weight. Can the landlord write a statement that he knows the room-mate is subletting to you? Can you show independent evidence of you both living there such as cell phone bills addressed to you, or even congratulatory cards for your wedding?

You will definitely want to show evidence of co-mingling of finances; joint bank account, evidence that even though the bill is in the room mates name, you both pay on it, being listed as eachother's beneficiary on life insurance and at work for being next-of-kin

That makes a lot of sense,

as

in the I-130 instructions, you two are to show evidence of this type of stuff (there are 6 types).

So, write up a letter of attestation about it,

and include photocopies of receipts for monies paid.

If you could fill in your timeline that would be awesome. If you're adjusting from a K-1 then a statement from your roommate will be fine. They don't expect a lot of evidence when you file right after getting married because there hasn't been a lot of time to generate it. I think a general rule is the longer you wait to file, the more evidence you should include. So send an envelope with both names on it, send your affidavit, and anything showing that your finances are mixed. And then spend the waiting getting both names on bills and insurance and wills and power of attorney papers so when you have your interview (or not) you have more evidence. And keep your evidence because at ROC you'll need all that you can get.

But if you don't have much when you file, it's okay. We filed a week after our wedding and only sent in one joint bank statement as evidence. We ended up with an interview waiver and an approval without a request for more evidence.
