My situation: my mom and I gained 2 years green card since my mom married U.S citizen in 2011.We came here in June 2013. Unfortunately, not so long after unification, my mom had fallen into a severe depression, she appeared to have trouble coping with her new life. I think it is partly my mistake because I chose to live with my aunt. I registered to the same high school as my cousin, so she could help improve my English at school and home. I feel guilty because I truly wanted my mom to spend more time with my stepdad. I thought it would be better if they had some time to themselves. From what I know, my mom couldn’t stop worry about her my grandma often gets sick, due to old age and no one else really cares, not even her sibling or the society over there. So, my mother went on a trip to Vietnam in September 2013 and has stayed there with my grandmother up till now. I was a minor and do not know what was going on between my mom and stepdad.

Last year, I received a notice from USCIS saying that my mom's green card and mine will be expired soon. I talked with my mom and she told me she has to take care my grandma and couldn’t go back to U.S. she also told me that my stepdad and she are going to file a divorce because disagreement. Without her, I’m on my own filed form I-751 along with a letter explaining why I filed form I-751 separately with my stepdad. Weeks after I received I-797 saying that my conditional resident status is extended for 1 year. Later in that month, I received I-797C and went to local USCIS office to have my biometrics taken (16 days before my green card expired, which also was the day I turned 18). After 2 months I received I-797E requested for more evidence about the current marital status of my mom and stepdad, and evidence to prove that the marriage was entered into in good faith. I didn't have any documents to submit since my mom only stay 3 months in the U.S, it was too short to yield any paper documents. I signed I-751 waiver and submitted it along with the copy of Joint Petition for Summary Dissolution since my stepdad just filed a divorce a month before. Now I just received a notice from USCIS saying that I am going to an appointment at local USCIS office next week Feb 8th. The reason of appointment is I-751 waiver saying that I need to bring the letter, valid passport, ID, current evidence to establish valid relationship, proof of joint ownership of property. It doesn't say on the notice, but I highly believe I will have an interview when I go there. I recently know that my mom and my stepdad had joined bank account and bank statement has both their name and a picture of us taken with other relatives when we went to Disney Land before my mom left that I should have submitted with form I-751. I'm still waiting for divorce degree, but I highly doubt I will have it before the appointment. I know these are not enough but that's all I got.

What else should I bring with me (before and after we gained green cards)? No child in this world deserves a broken family or be a victim of a fail marriage. I'm so stressed out since I'm pursuing my education. Going back to where I left off is like a life sentence without parole. Any advice or suggestions for my case?

As long as you are good with your step-dad cant you ask him for a letter of support from him

and have him explain the marriage is bonafide but coming from a different culture your

mom sees it as her moral duty to look after your G/mom since her siblings dropped the ball,

also get letters from school & church of your character and those who knew a bonafide marriage

existed

Expect problems.

Obtain all the evidence you can that your mother and former stepfather's marriage was bona fide.

Consider retaining an immigration attorney and having them attend the interview with you.

If the marriage only lasted three months then there may not be much you can do. You may ultimately need to depart the US.

The interviewer requested more evidence and gave me 3 months until May 8th to submit the final decree. My stepdad told me that he will have the final decree in mid-April. But the only thing I'm worried about is because I don't have any evidence to submit (besides wedding pictures, pictures they took before married that I already summited). I'm afraid they won't approve. What is going to happen next if they deny my case? Is there any different If I withdraw my application?
