Hi there!

So, I have been here for 8 years now, and am in the process to fill for the n-400 form....While I had been confused by the status of some questions( whether to say yes for being convicted of an offense( a speeding ticket 6 years ago and paid under 100 dollars) or yes/no to being detained ( while the officer was proceeded with the ticket), I finally decided to say yes to both questions and come with the proof of payment( although any tickets under 500 dollars and not resulting in an arrest do not need any documentation)....Now my question is: by saying yes to these questions, will it affect the interview date setting?....Meaning that "clear" files would take priority over " complicated", "confusing", "heavy" files?....

Thank you, Nancy....I guess my question regarding eventual additional delays in treating my file if you answered yes to a few of the tricky questions is specific to people who have worked an I/O....I would assume that whenever they see a yes for those questions that they would read the explanation to evaluate whether it is serious or not....

Your interview will be scheduled after your background check and when your office has an available slot for you.

So the only question is whether saying yes to one of those questions will delay your background check. I haven't seen anything to indicate that that is the case.

The incident you are worried about will probably already appear in your background check, which means that listing it won't make any difference in terms of how long the checks take. If it doesn't appear in your background check, then you're going to be asked about it at the interview.

Things like this may delay your approval, but they will have no effect on your interview date. In many cases, your application hasn't even been read in detail before you walk in for the interview. So while the explanation is important, chances are that the first time your answers are reviewed will be when you're sitting right in front of the interviewer. So he can just ask you about it and put the explanation in your file.

Things that will extend your background check include having a common name or odd travel history. A criminal record actually shouldn't delay your interview. If you were once arrested for punching a police horse in the face, it'll show up as soon as they run your criminal history. It won't delay your interview at all, but it'll probably delay your approval.

I may have misunderstood your second post and I may be wrong, but I don't think you're going to find people who have worked as IOs here. We are all just laypeople basing our responses on common sense, what we've researched, what we've read on here, and what we've personally experienced.

I don't think you have much to worry about regarding the interview date. Best of luck.

the question on the form is quite clear imo - have you ever been cited/arrested...?

since you were cited, you put yes, add details and don't bother with documentation since it was under $500.

whether or not it delays anything is irrelevant, but from personal experience, it doesnt seem to.

2006 - Entered US on F-1
2009 - COS to H-1
2011 - Married USC

Conditional GC Process:
04/2012 - Concurrent I-130 petition / I-485 AOS / I-765 EAD / I-131 AP sent
35 days to biometrics, 73 days to EAD/AP combo card, 85 days to interview, 96 days to Conditional Green Card

04/2014 - Eligible for ROC

06/2014 - I-751 package filing joint with spouse sent

5 days to extension,37 days to biometrics, 172 days to CSC transfer, 247 days to Green Card

04/2015 - Eligible for Citizenship

09/2015 - N-400 package filing on basis of USC spouse sent

29 days to biometrics, 105 days to interview, 147 days to oath and US citizenship

~ 9 years and 6 months from first entry to US citizenship

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Answer Yes to traffic tickets and gives details and actions taken to correct the citation. Minor traffic citations will not effect your case as I answered them Yes and I had 3 too.

Under oath, the IO will most likely ask the same question to you even your background checks are clears. And you will tell him the truth and it'll bear no consequences on the decision for the minor traffic tickets.

If u are confused in the answer yes or no don't put anything until u appear at the jury registration and tell them the story show them document that's what my husband did when he was confused about one of those case yes or no ? It was about arrest he wasn't arrested but was charged by friend from the police .he asked jury explained to her what happen she told he to put yes and she hold her application and called her after 6 months to pass interview and he got it , tell them the truth never lie because laying my cause prison for this application they will not consider it as error , good luck .
