Hi guys, apologies if this has been asked already. I tried to look for it and had no luck (maybe because it's a silly one).

I have an example cover letter that I am using for the AOS package. Under I-864 it lists a copy of U.S spouse passport page (ie. the USC, me being the k-1 visa holder). His passport is expired. Should I still include it or is this simply for identification purposes and I can attach a copy of his birth certificate instead?

Any help is greatly appreciated!

Cheers

Hi,

The copy of the passport page is used to evidence that the sponsor is a US Citizen.

You can include a copy of the birth certificate in lieu of this but, I think this evidence is actually only needed for joint sponsors and not for petitioners.

Definitely still include it. Maybe make a note in the cover page, or attached to the photocopy of the passport that, yes you acknowledge it is expired, but still included as required.
