Hi,

I'm a US citizen based in Dallas, Texas and want to marry a Jordanian citizen. We can apply for the Fiance visa or get married in Jordan and apply for the Family Visa.

I have two questions:

#1 Which has a faster processing time ? K1 or the Family Visa ?

#2 The K1 Form asks for 1 year of Tax returns and I didn't work from 2011-2014 but did have enough savings to survive. Then started working as Self-Employed in Jan 2015 so have Tax returns for the previous year and it is above the minimum required income. Also, have liquid and house as assets. Is it possible they will ask for last 3 years of Tax Returns ? Then, should I instead of myself, ask someone else to be the sponsor who has 3-years of Tax returns ?

Generally K1 is faster, when it comes time for the I134, 1 year of returns should suffice, but it would be smart to send your fiance with a cosponsor just in case, better to have one and not need it then need it and delay your case while you prepare more paperwork

So if I also decide to use a Co-Sponsor, is there a separate form for that ? On the I-134 I don't see anything related to a Co-Sponsor.

Do we provide the I-134 form (Affidavit of Support) with all supporting documentation at the time of the K1 Visa application ?

Also, can I be the sponsor plus also get a co-sponsor since I was out of a job for 3 years until Jan 2015 so only have last years tax returns which shows any income really and it is possible they might ask for my last 3 years tax returns.

Hi, just wanted to ask if a W2 from my petitioner would suffice his Affidavit of Support since he can't have his income tax return until April?

Firstly, what does minimum income requirement for the Affidavit of Support mean ? Is it before or after taxes ?

IMO, W2 should be enough but if the person has a 1099 then it might be different since he has to take out expenses and such from his Income.

What do you people think ?

According to the 02/19/2014 version of the I-134 instructions, if you are employed as a W-2 you need

B. Statement(s) from your employer on business stationery showing:
1. Date and nature of employment;
2. Salary paid; and
3. Whether the position is temporary or permanent.
Tax return is only required in the case of C. If self-employed.
If W-2, petitioner must have this statement.

A self employed person uses line 22 from the most recent tax year's form 1040 tax return as their income.

Assets must be valued at 3X the income needed and must be convertible into cash within one year without undue burden or harm to the sponsor. See the form I-864 instructions about asset valuation requirements. (This would also apply to a form I-134 submitted in support of a K1 petition)

Hmm. I cannot find a Form I-134A either. I think it may have been superseded by the 02/19/2014 version of the form because the instructions are agnostic as the relationship of the sponsor to the beneficiary. I think you can use the current I-134.

The I-134 is not part of the I-129 packet. It is part of the package sent to beneficiary to present to the embassy.

The income requirement is gross - so before tax (basically $10/hour for full time employment) for a family of 2.
