Visitor Visa - Denied once, but trying again

I think the officers thought he was trying to bypass the K1 process by purchasing a ticket to visit. Being a one-way ticket only made it look worse even though you and he had honest intentions. A one-way ticket generally screams "no ties/plans to return to a foreign country". Coupled with a K1 application it bodes very badly. I hope that with a good explanation of the circumstances that he is allowed entry again. To me, your situation is what one-way tickets are made for. It is a pity that others use it to try to circumvent immigration processes so now everyone is "punished". Good luck! :)

He had plans to return of course, but CBP sees him as a border jumper. Hah, my fiance as a border jumper...it's so laughable. My mother even called CBP to explain she bought the ticket so that he could be my support. Well, they couldn't care less. My mom even offered to buy the return ticket on the spot! That just shows where their priorities lie. Luckily, my mom was able to get a full refund for the ticket after telling the airline what happened. My fiance wasn't there for me when my Pappy died. My family and I went in to see my Pappy the day my fiance was supposed to come down. I was devastated and crying, and my poor Pappy who was a rack of skin and bones and couldn't even hold his head up told me that things will be better and that he will be down soon. My dying grandfather who had nothing left of him gave me a little flicker of hope. My Pappy's quality of life was so terrible at the end, yet he still had a positive outlook as he lay dying.

Then go visit him?

That's the problem. I'm a full time student in college. I also work on top of that.

Then unfortunately you're between a rock and a hard place. He can try and risk it, but it is a financial risk indeed. I was turned away when my so's mother had a heart attack and rightly so as I only had a one way and was going to watch his daughter. 6 months later she passed away and lucky for me I was let in no issues, not even being pulled into secondary.

With that being said, you think they place a time frame on the flagged person? So if my fiance were to wait, say, another 4 months, that flagging the CBP put on my fiance would be lifted?

No. Once you're flagged you're flagged. I got lucky. I was on the first flight of the day out of Pearson airport at pre clearance. The border guard didn't even scan my passport, it was a very busy morning so it was a quick check of my documents and off I went. My last trip the cbp was slightly hesitant to let me go, but I had been out of the USA about 6 months asking questions about where my family lived and if lpr or citizen. I was shocked that I got through so easily especially as I was visibly pregnant

No he is flagged for now and indefintely. Each time he enters he will have to show strong ties between canada. Again, all you can show are the ties you have. so book a return ticket, show the ties you have and it all depends on what CO he has at the border. I really dont think he will get through, but you never know:) being from canada you have it much easier than 99% of the coupels on this board where it is so easy for you to go and visit him (and if he gets turned oround it quick to home).

If it was me pesonally, having filed a K1, i wouldnt risk it.

Absolutely. I went through the majority of my pregnancy 2 months-8months without my so. It sucked not having him there for ultrasounds, heartbeats, or just to share the miseries and joys of pregnancy. But it's all over now :)

does he own a place? rent? or live with his parents.

What kind of job does he have.. a good job.. a solid career? When did you file the K1??

like i said, he can always just try once more and bring a return ticket and EVERY tie HE has to canada. Nothing his mom/dad/siblings/ or YOU can say that will help. They already know he has a petition pending. Evyerthing he said was recorded and the officer has it all on record. So just bring REALLY strong ties and see what could happen.

You're a trooper, lady. I don't think I could ever go through that experience without my SO. Power to ya girly...

He lives with his parents. He went to college for a year but stuff didn't really pan out for him when he tried to go back his second year. He works for a local handy man company where he lives and is currently doing snow removal. No solid career because of him moving down here and getting married to me and because he will attend college once more once he's settled in. We had our I-129F approved literally 2 days after he was denied entry to the US and now we are working on getting everything together for the interview (Packet 3 stuff) and we filled out the DS-160.

I thought about going up to him for spring break but my mom still likes to wrap me in bubble wrap (and i'm getting married how???) and she doesn't like the idea of me going up. I've explained so many times about how she doesn't get what it's like to be apart from your SO. I would love to go up and see him, but right now I don't have good funds either and I'm working on trying to improve that so I can pay for the rest of the immigration process. Oh sigh...
