Denied Employment while i-751 is pending

Hello,

i have a conditional green card which has expired last december and i applied to remove my condition during the 90 day period and i received NOA I-797 stating that my conditional resident status is Extended for one year, since then i did my biometrics and waiting for USCIS.

yesterday i applied for a job through staffing agency and the lady at the front desk told me she cannot accept the green card and the NOA letter, i told her that it says clearly that i am allowed to work and travel for one year and she even showed her manager and they both said they cant accept it and i have to wait for the new card.

can they do that? and what can i do to prove that i have the right to work?

i have a job interview next week at a different company and i am afraid the same thing is going to happen, what should i do?

also my social security card is restricted with DHS authorization, do i need to change it?

any help would be greatly appreciated.

You should go to the SSA and get a new social security card without the "valid only with DHS authorization" on it. The number will be the same. That way when you fill out the I-9 form you only need to show them the SS card plus a drivers license, you don't have to show them your green card, and you can avoid that situation entirely.

You should only need to show them your documents the day you start work and fill out the I-9 form.

Thanks for the info, is there any chance that the SSA gonna tell me that i need to wait for the new card or can i change it while its pending?

You could get a new Social Security card if you want, and that will help you have another avenue for satisfying I-9 requirements, but there's no reason why you should be forced to do that. You are allowed to choose to present any set of documents allowed for the I-9, and the employer cannot refuse to accept a valid set of documents, or ask you to present a different set of documents from what you chose. They must accept whatever allowed set of documents you choose to present. If they don't, that's illegal discrimination and you should contact the Office of Special Counsel for Immigration-Related Unfair Employment Practices.

SSN card that has restriction removed should work. But they should or cannot deny you with expired GC and I797 showing extension for a year.

Temp agencies don't know anything.

They almost denied the SSN verification and background check of my wife because "someone born in this year couldn't have been issued this SSN number."

I straightened them out real goddamn quick.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
