I travel ALL the time, what addresses should I use for L1-B to GC AOS?

Hi all,


My situation:

I am currently in the US on an L1-B, expires in 2018. I recently married my wife - a US citizen. It seems like I should be eligible to apply for AOS while I'm here.


The tough part:

I am an internal consultant and travel constantly - 100% travel (hotels, short-stay apartments etc.). My real permanent address, as far as my company is concerned, is outside the US, and I go back every couple months. In the past 2 years I have "lived" temporarily in 7 different locations for at least 1 month, but never more than 4-5 months. My wife resides permanently in the US (Colorado) and we've "lived together" in various locations, from a few days up to a month at a time, over the past couple of years.


I cannot say for certain where I will be living in 3-4 months - it will be in the USA, but depending on the nature of the project I'm on, it could be in any state. As a non-resident alien, the "address" section on these forms seems weird given that by definition I don't actually reside in the USA.


My question:

Should I use her address on all forms that I submit? I visit her usually once a month. This would avoid me having to constantly submit the Change of Address to USCIS. I would always be able to come to Colorado for any appointments / interviews etc. and this is where I plan to reside once I have the Greencard - although I'd still be travelling 100% until I finally get a different job.


Specifically:

I-130:

Part C, Question 2 - I'm about to move into a hotel ... wouldn't it make sense to just use her address?

Part C, Question 19 - Since this is L1-B to GC ... should I put N/A or None ... or my actual address back home?

Part C, Question 21 - We've never lived together officially, just long visits... so i'm just saying that?

Part C, Question 22 - I put Denver, CO


I-485:

Part 1 - I put her address and c/o in her name


I-325A:

Addresses past 5 years - Is my present address her address in the US, or my address outside the US, or the hotel I'm going to stay in?

I also have never been at her address for a full month ... I'll list it here anyway


I-864:

Part 2, Mailing address - I use her mailing address in the US?


I-693:

Part 1, Home address - Do I use her address in the US or my address outside the US?

  • 02/11/16 Concurrent filing of I-130 & I-485 sent via FedEx
  • 02/26/16 Hard copies of NOA's arrived in the the mail
  • 03/04/16 Biometrics appointment letter arrived in the mail
  • 03/07/16 Unsuccessful early biometrics walk-in attempt at Aurora, CO
  • 03/15/16 Successful alternate location biometrics walk-in completed in Milwaukee, WI (on actual appointment date
  • 04/19/16 I-765 approved and new card ordered
  • 04/23/16 EAD received
  • 01/09/17 Case scheduled for interview - notice received in the mail
  • 02/14/17 AOS Interview - approved at the interview - happy Valentine's Day!
  • 03/21/17 Two Year Card received!

 

LOC:

  • 12/20/18 Filing sent via USPS
  • 08/01/19 Successful biometrics in Aurora, CO
  • 10/23/19 I-751 petition approved and new card ordered
  • 10/31/19 Ten Year Card received!

 

N-400:

  • 04/08/20 N-400 received at USCIS
  • 10/28/20 Biometrics re-use
  • 11/09/20 Interview notification
  • 12/16/20 Interview, approved, Oath, Citizen!

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If anyone has a similar question - the really helpful lawyers over at Avvo responded with some answers.

In short, it's more about common sense and what I would consider a permanent location / intention versus actual time spent. I'll be using my wife's address for my location and explain in the interview that I am frequently required by work to travel to temporary locations.

If anyone has another opinion, would love to hear it!
