K1/K2 - letter of consent from the other parent

Thank you for your replies and advice. Oh I'm glad that the Embassy wouldn't ask for it, that way we could have our visa and just wait for the completion of the Court Order process. Yes, I need the order for the Court for my own peace of mind. Knowing my ex, I'm sure he'd take his revenge on me for going to prison by accusing me of child abduction. He doesn't really want anything to do with the kids, but it would give him the satisfaction that he would cause me distress by doing so.

The CAFCASS has started the process too so it looks like it is all coming together now.

I would like to add this tho, when I left the UK to return to Australia as I had a one way ticket I was asked at check in if I had the fathers approval to leave the country with the children, luckily he was with us, he was asked to show id and I had to produce the kids birth certificates to prove he was indeed the father, this also happened at check in, in Australia when I was leaving there to start our life here in the US, so that's where the notarized letter came in.

Hello. Wondering if someone could help please. I was married briefly in 2008. We separated in 2009 when I fell pregnant. Divorce was final after my daughter was born. My daughter is not mentioned in any divorce proceedings nor does she carry his surname. He's also not on her birth certificate.  We've had zero contact since 2009 and the CSA cannot track him down as being in the UK. I wasn't aware I needed his permission to take my daughter to the US. Our interview is on the 31st and I'm going to the court today to ask for permission which we won't get in time for her to start school in September. Can this stop us from moving over? From what I understand I am the sole parent with parental responsibility as he's never been in the picture. He's never wanted to or made attempts to see her or communicate with her and he's nowhere to be found. Any advice please on what I can do? I'm worried we'll be stopped at check in but I've been told so long as I have her birth certificate and the letter from CSA stating communication was attempted I should be fine?
