And please make sure he knows that he can't adjust once he is here and make sure he doesn't say nothing of the kind when customs ask him what he is doing here! He'll be put back on a plane faster than he can blink!

My sons AOS and IV bill paid March 23rd (status in progress)
My sons AOS and IV bill shows as paid March 26
My IV bill paid March 26
Both packages sent on March 26
My IV bill shows as paid on March 27th
CC on both cases March 30

Current record holder of fastest through the NVC :D

Medical exam in Stockholm April 13th
Interview on May 16th !!!
POE Anchorage July 12th!! 2012

July 2015 n-400 in the mail

September 2015, interview

October 23rd 2015, Oath ceremony!!!!!​​

So, spouses of LPR with an unexpired visa get a F2A category, correct?

the I-94 governs legal presence.

It's not enough to rely on the expiry date of the VISA.

so, if he's out of status during interview day, he cannot successfully adjust status.

how to be out of status? stay here after the I-94 expires.

please understand, having a tourist visa is of no consequence, to be granted a spousal immigrant visa.

sure, he needs it to get into the country and actually marry, but it's not part of the I-130 adjudication process, to seek a visa, at all.

People in any category can adjust status if their priority date reaches the priority dates that can file AOS and they are in the US in legal status at that time. However, the wait for priority date to be able to file AOS for F2A category is currently about 8 months, which is too long to remain in visitor status. If he were in some other status which can remain in status longer, it would be possible.

So he can only file for AOS only after about 8 months of his wife filling I-130, and he needs to have a legal non-immigrant status to do it.

Yeah if he happens to be here again in 8 months and just in a spur of the moment decides to adjust thats fine.
