(b) file for divorce, remove conditions by yourself using VAWA.(Violence Against Woman Act). If you are treated bad than I would file report with Police and move on.

The OP never mentioned any violence, or anything that would need to be reported to police. And she doesn't need VAWA to remove conditions by herself.

Abuse isn't always violent. Abuse can be emotional, psychological or even financial (as in OP's case, possibly).

I already agreed to this arrangement long back. Surrendered to his request to avoid having joint account and give him expenses in cash.

But after doing that he says I am doing it but very transactional (not doing it genuinely) and that is why he wants divorce now.

I even gave him a blank check to show him that I am trying to do it genuinely. Its all the mistrust that he has developed in his head!

Only god can help me here. Thanks Jam for all your inputs! God bless you :)

I am sorry to hear the situation you are in now.

You may have already done so but my last advise is to seek help from (yours and his) friends to help with his suspicious mind.

You (the suspect in his eyes) have very little thing to do or say anything to change his mind other than completely given in to his demands (which to me is unreasonable).

Marriage consular (paid by you) and friends may be of some assistance with the mistrusts. I think you love him and he love you so there is a chance you both could save the marriage.

Best of luck to the both of you and God Bless!

Abuse isn't always violent. Abuse can be emotional, psychological or even financial (as in OP's case, possibly).

Following things have happened during the last few months since he and his family started pushing me for money and investments.

1. He withdrew showing love, affection and physical relations

2. His father told me to leave the country and go back to India. When I told him I will check with Cops if asking me to do so is the right thing to ask, he snatched away the phone from me, punched me and left me with bleeding finger. Husband snatched away cell phone and threw in toilet. Later he pleaded me to not make a call to cops as it will spoil his career and everything. I did not make any calls. His parents left the house next day and moved to relatives place. Husband went out of house for 3 weeks. They all told me they got scared if I call cops, hence they left me alone in house.

I thought it was my mistake to tell them I should check with cops and should not have done that

So spouses who are emotionally and psychologically abused should just tough it out and stay with their abuser so that they can file for ROC jointly? Or maybe wait until their USC spouse hits them?

Yes it is harder to prove but not impossible. Abuse is abuse and should never be minimized.

1. I spoke to his close friends, who so far heard only his version of stories. When I told them the complete situation and they tried to talk to him, he said its his personal matter and will sort out with me.

2. Already did marriage counseling (whose payment I did) but still could not generate trust in him (In his words, I am doing things transactional).

Thank you for your prayers :)

I don't know how they do things in your state but you could call the non-emergency line of your local police station and ask about your options in filing a police report or something that can document the abuse. You can also call the national DV hotline to ask about available resources in your area. Some shelters and DV organizations can help you get in touch with a lawyer who can give you advice on how to proceed with divorce and ROC.

Check the link in previous post re tips in gathering documentation for a VAWA waiver.

So so so sorry that you had to go through all of that. Do you have family or friends there that you can confide in to help you if you have to move out?

I don't think that anyone is saying it's not abuse. Or that it's less of an issue. Unfortunately the ideas of emotional and financial abuse are still rather new especially in things like these. Without documentation vawa is tough.

Even if OP wants to file ROC with extreme cruelty (VAWA) waiver, she STILL has to prove bona fide marriage with the example list of evidence I posted.

Done with K1, AOS and ROC

Many of you here are talking about VAWA. For God sake VAWA is for people that never got GC and suffered mental or phisocal abuse She can divorce and file form l751 waiver and she can choose the option extreme cruelty. Vawa CANNOT be filed by GC holders.

Thank you Sandra

Incorrect, VAWA has been used by conditional residents to remove conditions, when there is a registered domestic violence incident with authorities.

Sorry to open a can of worms by mentioning VAWA :-)
