Hi all,

I am filing for AOS from a K1 visa. Currently my wife is a full time student so for the I-864 her mother is going to be the joint sponsor. We all live in the same household so I am right in thinking my wife will fill in the I-864 and then her mother can fill in the I-864A as the joint sponsor because she is in the same household?

Any help is appreciated, thanks.

AOS from K1:

02/01/2016 - AOS, EAD filed

02/25/2016 - AOS and EAD NOA1 (received 02/08/2016)

02/29/2016 - NOA1 hard copies

03/14/2016 - Biometrics

03/31/2016 - RFIE for AOS

04/06/2016 - RFIE received

04/11/2016 - RFIE evidence sent

04/14/2016 - Updated to say evidence received

05/17/2016 - EAD/AP approved

06/13/2016 - EAD combo received

06/16/2016 - Green Card Approved (no interview)

06/25/2016 - Green Card received

Right. Does your wife's mother claim any other dependents? Make sure she makes 3x the poverty guidelines and counts 3 people: herself, her daughter, and you. See here to find out the amounts: https://www.uscis.gov/sites/default/files/files/form/i-864p.pdf

You wife could add mother as her household member who is contributing. The I-864A from mom is kinda like giving permission to your wife to list Mom's income on wife's form. Mom can also do her own separate I-864, which I think is the better choice since she makes enough on her own.

The method of using income from several people in the same house is more for when nobody qualifies on their own. If wife made $15k and Mom made $15k, nobody qualifies. But if they live in the same house, USCIS allows them to pool their money to make $30k for qualifying.
