Hey everyone

My parents have applied for immigration visas for both my sister and I when we were both over the age of 21 (F2B). After 6 years we were delighted to have finally received an NVC letter and started working on documents immediately.

We have 2 separate applications with separate NVC case numbers and separate Invoice Identification Numbers. However when signed in I saw my sister's case as a related case and paid one AoS fee. My sister has also confirmed that when she logged in she can now see it as paid like I do.

Now the question is when filing I864 (Or even whether to file that).

Considering that each application is for one person, does it satisfy I864EZ question 1.c. The sponsored immigrant is the only person immigrating based on the underlying visa petition? (I believe it does)

Regardless of the form (I864 or I864EZ) is the number of household 3 for each application? (My dad, who's sponsoring, my mom as the spouse and me on my form; my dad, mom and my sister on my sister's form)

Another thing: My parents have since become US Citizens, they'll be checking 12.a. I'm a US citizen, do they have to to enter 12.c My alien registration number is:

Yes, there is one fee that is paid individually and the other you pay once and it covers all who has applied. The IV fee is paid per person ... and the AOS fee (not to be confused with the Adjustment of Status fee) is a one time fee for all who are applying and related in cases.

You filed individual/separate visa petitions so for each I864, you would answer yes.

For the number in household, you would put 4 .... you need to include all that will be living under your roof/supported, including members of the sponsor's/petitioner's household (if you used a sponsor).

The Petitioner does not have to fill out an alien Registration number if they are U.S. Citizens.

Aug 21 2015: Notice from USCIS that all 3 petitions transferred to California Service Center

Sep 17 2015: Approval for all 3 petitions

Nov 12 2015: Paid one AOS fee for all 3 children

Nov 13 2015: Paid separate IV fees for all 3 children

Dec 04 2015: Filed Affidavit of Support (I864) for each child

Jan 12 2016: Received RFE for missing birth certificate from one of the kids packet

Jan 13 2016: Sent in RFE evidence ( birth certificate copy .... again O_o )

Jan 19 2016: Received notice that they received the RFE evidence

Feb 22 2016: Called and found out another RFE was being sent out about birth certificate

Feb 24 2016: Sent in (inextensa versions, not de acta versions) of birth certificates for all children

Mar 02 2016: Received notice that they received the RFE evidence

Mar 11 2016: NVC Process finished, now awaiting interview time slot to be scheduled

Mar 29 2016: Called NVC and found out today they scheduled interview

Apr 01 2016: Received Packet 4 notice via e-mail with interview date

Apr 25 2016: Children received P4 letters in the mail

May 19 2016: Interview

Jun 03 2016: Received Visas

If all is yes the we can both go with I864 EZ then in our separate forms.

Now this part however doesn't match with what you have suggested

1a self =1

1b spouse = 1

1c dependent children under 21 = 0

1d if you have sponsored any other persons on a Form i864 who are NOW LAWFUL PERMANENT RESIDENTS in the United States... = This I believe should be 0 as there is no approved case yet.

1e If you have any other dependent listed on your most recent Federal income tax return = 0

1f Add together items 1a - 1e and enter the number here. This is your HOUSEHOLD SIZE for the purpose of this form I864EZ = 0

If I use 864 that would be 3 because it asks the number of people in this very specific petition (which would be 1 for each petition)

Luckily he makes about 3 times more than the minimum required amount so I am not trying to lower the number and try to get away with the threshold. I just want everything going as smoothly as possible.

you are correct. It should be 3. (unless you got any children ? :) ) In my case, I filled out the forms for children and not over 21 adults. :)

I would double check around to make sure it will be 3 though ... I've read on other posts where it was the other way
